In this prohibition aro not included such persona as have heretofore held mere county offices under any rebel Sutte CSovcrument. I regard this as the true interpnUtion of the provision iu question. It was the intcntiou ot the framers of the Constitution either first, to limit the eligibility of all the elapses mentioned' lo. Jpete county officers, .- secondly, to exclude all elapses mentioned, pave county cRk-eid liom eligibility to office and to confer on meie county officers tho right to be electtd to any pooition in a county office or otherwise. I m ideally of the opinion that the latter 'n the true intention. The contrary construction of the section would be attended with muy anomalies. First, it would permit any officer of (he so-called Confederate Government to hold a county t Rice, when by the terms of the article as originally adopted and as it stood until recently amended he could not vote for another person for the caine office. County officers ot merely local and limited jurisdiction, would be pUced under the tame ban with the highest officers of the so called Confederacy or rebellious State Government. Again, as I have already said, the section in question is mainly employed iu describing the cltsses ot persons not eligible to office. This construction accord with the general intent. It constructs the words, excepting there from county officers, as description pcrsonarum, and not aa indicating the ofi'eraea to which the proscribed clscs are. notwithstanding their profcriptioa, eligible The opinion I am giving refers merely to constitutional offenses; as to such of!'enes as aro not created by the Constitution, the prohibitions before mentioned do not apply.
