And to this end webegtc submit the followiug facts Ou the morning of Saturday f February 20th,), and while petitions were being presented, (no other business being in order except by consent of two thirds of the House.) the gentleman from Jefferson (Mr. Bonhara.) offered the followtcg resolution: Keolved, That House hiihj Xos. 17G.133 and 140 be msde the rpecitl order at int.; o'clock to day (Feb. 25th j. Shortly afterwards, resolutions, JLc, beiug called for, the suae resolution mhs. again offered by the gentleman from Jefferson. Saya Mr. Or.tlow. one of tbe ablest of the -paker? of the flritish Hoc-e of Comraoc: " It was maxim !. htd often heard when be ws? a yocc rein, from old ahd experienced member, that nothicg tended more to throw power icto tbe bands of the administration and thoe who acted with the msprity of the Houe of Common, than a reglectnf, or departure from the rules of proceeding; that the?e forms as instituted by ocr ancestors, operated a a check, and controlled the actions of the maj ritv; and that they were, in mtny instances, a shelter and protection to the minority, sgair t the attempt of power." Says Mr Jefferson : "So far the maxim is certainly true, and ia founded in good sense, that a it it always in the power of the majority, by their nuobers, to stop any itcproper mtssure proposed on the part of their of porent", the only weapons by which the minority can defend themselves against similar attempts from those in power, are the forms and rules of proceeding which have been adopted s they were found necessary from time to time, an 1 are become the law of tbe House; by a strict adherence to which the weaker party can only be protected Irom those irregularities and abuses which these forms were intended to check, and which the wantotees of power is but to often apt to sugfcit to large and successful mtjoriiies." And whether these forms be a all cases the moat rational or not is really not of so great importance It is much more material there should be a rule to go by than what that rule is; that there may be a uniformity, a proceeding in business not subject to the caprice of tbe speaker or captiousness of the members. It it very mate
rial that order, decency and regularity be pre- j served in a dignified public body (2 Hats "li; Jefferson's Manual, pages 13 to 11. But the miiority of the Houte, overlooking tbe fact that these rules, being in pari materia, must, for the purp it?of interpretation, be considered together; they therefore refer us to rule 57 alone, and int that by the words "unless the Houe ehtll direct otherwise" the whole legislation is at their mercy. Vet, is not its plain meaniug, when we consider it iu cornection with rule 63, that the House thail not direct oth erwise except pursuant to its rules, which require a two-third vote, or (as in the course in congress, that where a measure is reached in its or der it my be passed over by a majority, and which of itself does not involve a suspension of the order of business. The rule in congress upon this suhject (No 127,) id precisely the same as rule 63. See Jefferson's Manual, page 161. And we know of no piecedent analogous to the present proposed action of the majority iu the legislation of Congress since the adoption of said rule; nor of any in the legislation of Indiana. Rut if it it tt ill claimed that rule 07 warrants a different construction, then we i;ist thit it is in cot diet with rule C3, which being theUst expressed will of the Hou-e, whom the subject must govern. Rut as the majority still in-ist uoon this alleged unnecessary and hurtful pro ceeding. the only result of which, o far, has been to stop the usual coure of legislation, we mo-t respectfully submit that the minority must not, nay, cm not yield It would be wrongful to themselves and not permanently adv.mtageous to the present majority. The ur.dei signed still further piotet that it h cot now nor has it been their purpose to delay or prevent any rightful or necesary legislation, but simply to defend their inherent and constitutional right. This wa evidenced on five several occa sions during last Saturday, and while the obnoxioLS resolution was pending, where (ncnibet of th minority asked the unanimous consent of the House to pas it over and to take up the ap prepriition bill?, hut at each time were defeated by the opposition of gentlemen of the majority and thnf, '.(withstanding said rebuffs, they are yet willing to renew at nny time such proposition or to accede to it as a proposition from the majority. In conclusion the undersigned beg leave to say that they ate now, and indulge the hope that they ever will be, readv and willing to co operate with the majority in all legitimate legi? lation, and that if it fails, the responsibility mutt rest, a it tboulduo, with the majori; v J.R Coffroth of Huntington and Whitley, Jason R Rrown of Jackson. The Herald's Washington special fays there is a declatalion in the rebel papers that preparations have been made lo meet and check Sherman, which is con elusive proof that he will meet with no serious opposition in his progress through South Caro lina. The evacuitior: of Fc-rt Anderson and the capture of Wilmington has not been noticed in any of the Richmond piper. Tbe rumors circulated by seeesiorji-ts of Lee's having a movement in progress northward, are without foundation. About 150 men per day of his army reached here, taking the o;th of allegiance to go north. The World's Wilmington special says the 104th Ohio regiment has been assigned to'd i provost guard duty, aud it commander, Lieut. Colonel Jordan, Ins been appointed provost marshal of that po$t. The Mayor renders every assistance to enable him to get his department in working order. The city has been divided into tbree provest districts. The rebels left bnt a sml! quantity of stores behind them. The navy yurd, t-evtia! foundries and all the vereis that could not be removed weredestroved or burned. The privateer CLickamaugi as sent up Cape 'Fear river. An engine and several cn which were hemmed in by Gen. Cox's movements, were de stroyed. All the hotels and neatly all the stores are closed. The Herald's Wa-hingtoii correspondent pre diets au early movement of Graut'n armies. He says the rebels are concentrating to endeavor to deteat Sherman, and the next few days will produce stirring events. Grant and Schotield re matituveriu to pre vent -ueh concentration. Tha Herald's Newbcru correspondent represents a very demoralized condition in the rebel military force- in North Carolina and a disposition on the part of both soldiers and citizens to return to the Union on the best terms thev can fiet- . Deserters fioni the rtLel army are contant!v coming into the Union lines. A small party of Union cavalry and infantry recently made an expedition to Wj.shing;ou, North Carolina, where they captured 30 rebel solJiers who apparently were very glad to be taken as they made no resistance. The Richmond Examiner, 21 iust. t,ays the Yankee force east of the Mississippi does nut exceed 125,000 men und says the South is being conquetei by one third of her number. It makes earnest appeals to the foutl trod tu come forward and help to drive out invaders. The Enquirer savs the rebels do not w?.nt more j men because they cannot feed or clothe them. I The Washington special to the Pos. gays it is creditablv reported that freeman ICark of Roch ester baa been offered the post of comptroller of currency, when it is vacated by Mr. McCulIoch. It will be probable that he will accept the position. The Tribune has Richmond papers to the 25:h, but they contain very little new-. The Raleigh Confederate of the tl announces the capture of Fort Anderson. The ssme paper says 300 Yankee officers prised here eight before last to Wilmington, to be exchanged. The Yankee authorities refused to receive them, and they were sent bvk.
