The first accident on the Terre Haute Railroad that we ever heard of occurred on Saturday, about a mile this side of (treencastle. Injberry," I7tli Ind., 175, the Court nav: "The fc-rd hows that on February 26. 1?59, the Council ordtteJ ad ertiseuienU for bids, for fpecinc street improvement-, and afterwards ap1 proved the contract mide for thee improvenient!." Tlie Court evidently regarded tliia order of Council a a subtanlial compliance with the ih irter. Hut the proceedings of the Comi mon Council were revtrei on other ground. In I earchit!' back throush the record the Court at the first error, and did not discuss this . order of the Council, but there having teen no i order upon property holden to pay the assessment, the precept was et aside Hut in the case I under consideration, there is neither a petition urion which a majority of the Council may act, nor is there an order or ordinance passed by twothirls or even by a majority of the members of the Common Council. This record shows simply an ordinance intro duced; next a report of the City Engineer, rnide nine months after the introduction of the ordinance, in which he says he had been directed to advertise for proposals for such improvement. The record does not show such order or direction by the Council to the City Engineer, and he can j not in ike a record tor the city. A contract was subsequently made bv the Citv Engineer, iu the name of the city, with the plaintiffs, to improve the street, and that contract was approved by the Council, by what vote the record does not show. Is that contract binding, and can the con tractors recover for work done and imt rovcnients made under it? This qoe-tion must be decided under this demurrer. If the views already expieced are coirect, the answer is clear. The Commoo Council can onlv act upon petii tion by the vote of a majority of its members, or by a vote ol two-thirds without a petition. Any attempt to ct in any other manner must fail. 1 his contract, then, is outside of the power conferred by the charter, and is void. The attention of the Court has been called to the loss incurred by the contractors. Dut when a party chooses to contract with a corporation that can only act within certain prescribed limits, the law requite him to look to the power and take notice of its limitations. It he contracts with the corporation outside of those limits, he cm not complain of loss resulting therefrom. The Common Council has the power, under er tain restrictions, to order improvements against the will of the owners of property in thetreets improved, and make the expenses of such improvement it lien upon the adjoining lots, and they may le sold to pay the lien. The Legislature has chosen to grant this power with thee limitations, and every propeity holder interested has the t iht to demand that the power shall only be exercised within the prescribed limits, and to invoke the protection of the Coutt against an ubtie ot the power. It the Court will not grant euch j. rotection, the limitations had as well he removed, and the jKwer at once made absolute. The demurrer will be entertained. Sword I'rkskntatiox. A very interesting ceremony came off on Monday night last. The private soldiers of the 2I Indian i cavalry purchased a beautiful sabre and belt for presentation to the irallant Lieut. Colonel Robert Ii. Stewart, who has long commuided the regiment and who has endeared himself to his comrades in amis by his chivalrous conduct on the field and b; gentlemanly bearing at all times. Colonel Stewart, it w ill lc remembered , declined the command of the 5th civalrv tendered him by (Jo ernor Morton, preferring to remain with his j coniriitle of the -d, with wliom he hid passed j through inii h hard service. j The presentation took place at Louis Line's, wheiea lare company of invited guests met liie brave boys of the 2d nnd their idolized com mander. 13.
