Rut the Journal editor, who is a very lenrtud and wise man no doubt, says "the Constitu ion of the United States comptls 'all rsons held to answer for any capital or otherwise infamous crime to te presentrd by a Grand Jury " There is no compulsion of this kind. Judge Marshall, who i rbably understood the character of the Constitution at least as well as the editor of the Journal, in an opinion disc lining the lh amendment of the Constitution tefeired to, pays: "Each State eiUbliihei ;i Cjnuitution for ite!f, and in local Constitutions, provided such limitations and restrictions in the powers of its particular government as its judgment dictated." In the Indiana Constitutional Convention ot lfl0, the proposition was made and favorably entertained bv a large number of its members, to abolish the Grand Jury system, which thep regarded as a relic of barbarism. In discusiu the proposition, Mr. Axtuont. not a Democrat, said: The real object ol the establishment of the Grund Jury ?)rtm in hngland was not so much fir the protection of the people" rights and tranchises as it was a co court and most powerful prerogative of the Crown, to the aggrandizement and sirenglhing of which it has always coutr.bu ttd. Under the Constitution then it appears that the Grand Jury system is not compulsory, but simply optional, notwithstanding the learned opinion of the very able editor of the Journal. Another poiut. The Journal says the Grand Jury ilidn't publish its presentment at all. Did it not make it public, puUish t: in full, by request in&tdie Court to spread it upon its public record? It says the Court ordered that copies be bent to the daily papers of this city, and then requests us to expUr i "why it (we) didn't j;et its copy and : publish it, as the Court ordered!!" The explain- j tion is very simple. No copy was j'eul us, and j therefore the order ot the Court was not . beil. $o far as e w eie concerned. ! Again. We did not aitd do not plead for the J immunity of trailers, as the Journal alleges, j We ü!y objected to the attempt, the infamous attempt of a partisan Grand Jury, a jxditieal e cret tribunal, to jTejudice the public and preeut the accused, to wbiih the meanest criminal h entitled, from having a fair aud impartial trial We sa'd, and we now aay, if the accused are guilty of treason, iu aiding and abetting tlut crime, punih them as the deserve, but there can be no more malignant act thau the attempt for partisan purposes to prejudge men who may be utterly innocent and who upou a fair tr a! may be acquitted of et en intent of wrong doing.
