w rit, as repuTcd, on a proper tition, in any case. The power to suspend the privilege of the writ, a exercised by the 1'resideM, has not been recognized by any State Court in America, a far as we nre at present informed. In the United States Courts the writ is purely a statutory right, giver, by a United States statute, which regulates the power and duties of the Judye in relerence to it.
We do not know how far the United States Judge
as-eiited to the power of the President to in
terfere with that statute, but our understanding of I the matter, on thr w hole information before the! public, is that tlie President has not JormtUy sus j .ended ti c privilege of the writ, hut ha u cer- j tain special instance instructed disobedience to j to the writ. If the contrary i true we shall le i very glad to be informed, and it would at once j place the whole matter in a shaj-e to be dicussed j with a cleaier Knowledge of whatjowers are claimed lor the President In the M er rim in ', case, it appeared that some one, on behalf of the ' (Jot eminent, did claim that by some 1 1 rh d or ( written order the Pi evident had suspended the j issue, or prit ilege, or effect of the writ in that! pirti' iilur cae, but we are wholly in the dark as !
to tlie actual order made by the 1 icsident, and '
w hat it was that he claimed to su-peud. The cxpie-sioii of the Constitution is, "The pi it ilege of the writ of ho hea enrpu sh ill not be

of the entire line of defense is an herculem task, and can not be ac ompli-he I sav e by persistent and irotracteil seige. The bombardment to day was not n vigorously persisted in a thai of yesterday, but the guns of our fleet seem to bave been more accurately directed, and to hate produced greater havoc among the works of the lebels. Not being able yet to chronicle a victory over any one of the enemy's wotks, we are unable to judge how se vere has been the loss sustained on the opposite side. I he .strongest argument that has been ad diked in support of the witter of the President to suspend the privilege, is that which is based on the general power gitcn to the President to take care tint tlie law are faithfully execute 1. In this, and o'l.er general powers, it is argued that
the Picsiilcnt is authorized, when the laws can i
not . in his judgment, be t aiihfuily executed otherwise, to su-pnd the writ of h'ihea enrno. The
argument is i uilty , in tint it holds that to exe- I cute one law, the President may violate aimther. j Hut, aside from this, the argument proves too
much, for it authorizes the President to do any desjiotic act. It he could suspend the writ, n such a ilea, he could equally as well hang a prii. er, on his imp warrant. The same answer ap
