It would powerfully te»d to counteract endeavors lo obtain appropriations of a local oba aeter, and cidefly calcula-ed to promote individual interes t, h he want of such a provision is the occasion of abuses in regard to existing works, exposing them to private encroachment without sufficient means of redress by law. Indeed, tho absence, in such oases, of r cession of jurisdiction, b.* constituted one of the coustitnlional objections to appropriations of this class. It is not easy to perceive any sufficient /eason for requiring ii in the ease’of arsenals nr forts, which does not equally apply to all other public works; if to da constructed and maintained by Congre s in the exercise of a constitutional power of appropriation, they should be brought wi; bin -he jurisdic.ion of the United Stales. There is another measure of precaution, in regard to auch appropriations, which seems to me to bo worthy of the consideration of Congress. Harbor improvements thus constructed and maintained, the expenditures upon them being def. ayed by tbe very facilities they afford, are a voluntary charge on those onl who see fit to avail themselves of such fac litios, and can be justly complained of by none. On the other hand, -o long as these improvements are carried on „y appropriations from the Treasury, tho benefits will continue to inure to those alone who enjoy the facilities afforded, while the expenditure will be a burden upon the whole country, and the discrimation a double i jury to places equally requiring improvements, biu not equally
favored by appropriat ons.
