Bk4, Mr. PresideDt, it is not * fact that Mi*souri was so admitted. Thai provision was in an act authorizing Missouri to form a State government, and providing lor her admission. What did she do? She tormod a State government, and presented her constitution hew ; was she admitted therefore, in consideration of this compact? Not so. The bill that was introduced tor her admision teas defeated entirely, and tor a long time was she kept in suspense, until Mr. Clay came in with his panacea—as he always hail for all the ilU of the body-politic a broad plaster that should heal all wounds and diseases—anti healed it all up. The Missouri compromise did not introduce Missouri to a position in this Government, nor was it by virtue of it at all; but a year afterwards Mr. Clay brought in a resolution, making another compromise, upon condition that Missouri should abrogate a provision in her constitution that she had already made by virtue of that law. It was not a provision that, having formed a constitution, now, therefore, ba it resolved, that she shall be admitted; but it provides directly— “That Missouri shall be admitted into this Union on an equal footing with the original States in all respects whatever, upon— Here is a condition—in all respects but “Upon the fundamental condition that the fourth clause of the twenty-sixth section of the third article of the constitution submitted on the part of said State to Congress, shall never be constructed to authorize the passage of any law, and that no law shall be passed in conformity thereto, bv which any citizen, of either of the States of this Union, shall be excluded from the enjoyment of any oi the privileges and immunities to which such citizen is entitled under the Constitution of the United States: Provided, That ihe Legislature oi the said State, by a solemn public act, shall declare the assent of the said State to the said tundamental condition, end shall transmit to the President of the United States, on or before the fourth Monday in November next, an authentic copy of the said; act upon the receipt whereof, the President, by proclamation, shall announce the fact; whereupon, and without any further proceedings on the part ot Congress, the admission of the said State into this Union shall be considered

as complete.”

That resolution was approved a year after the Missouri compromise. The Missouri compromise was made in March, 1820; this was approved March 2, 1821; aud this is th# condition on which Missouri was admitted— not on the restriction ot slavery. The absurdity of this provision was sufficiently commented upon by the Senator from North Carolina [Mr. Badger] the other day—the idea that by a solemn public act of the Legislature, the State could abrogate a provision of their own constitution, and should go to the farcical declaration that they would not violate the Constitution of the United States, and would not prohibit the citizens of the different States from going into the State, a security and guarantee given by the Constitution! But Mr. Clay, with his plgster and panacea, must have it covered over in this form. And now what was the provision that he required should be expunged, and which is the real Missouri compromise—the compromise on which Missouri was admitted? It was not that the southern men had agreed that slavery should not exist north of §6 ° 30min, but the condition was that she should strike from her constitution the following words: “It shall be the duty of the Legislature, as soon as may be, to pass laws to prevent free negroes and mulatloes from coming to or settling in this State under any pretense

whatever.”

Missouri had a provision in her constitution precisely soch as Indiana has now, that no negro or mulatto should come and settle in the State. Mr. Clay makes it a condition precedent to her coming in she shall repeal that. Do you suppose Missouri did it? Do you suppose she could do it? She could not do it. All men who have thought at all of the grades of power, whence they emanate and where thay terminate, know that the Constitution of the United States is paramount and first; that the constitution ot the State, not conflicting with the Constitution of the United States, or any law or treaties made under it, if next in grade; and that a legislative enactment is a mere cobweb when in contravention of tbe constitution; and hence it was a farce to say that tbe Legislature should abrogate a provision of the constitution; and upon condition it does, that the State shall come into the Union. That joint resolution of Mr. Clay, passed a year alter tbe Missouri compromise, did not yet let Missouri into the Union. Why? They had to go home; their Legislature bad to meet; bad to have an election, and immediately had to pass a law expunging their constitution; and then it had to be certified to the President of tbe United States, and be had to issue a proclamation, ta get Missouri into Union. And yet this question has been argued on the ground that Missouri of right, ear vi termini, came into the Union by the passage of the Missouri compromise. Nothing is mor? absurd. She was compelled to go home and do what she could, and go through the farce at any rate of abrogating a clause in her constitution. She did go home; and what did she do? She did not abrogate a clause in the constitution, for the Legislature could not do such a thing; but ahe paaaed a law saying that she would not violate the Constitution of the United States. 1 suppose that valitfind the President of the United Stales for the time being, who issued a proclamation, and^sho coma into the Union. 1 refer to this matter to show you that thay not ftimuhaneom acta; Mint it wan not anfoconaidaralion that Missouri should come into the Union that the Mieaouh compromise
