Mr. Emerson moved to reconsider the vote, which
was agreed to.
After some discussion, Mr. Reid moved to lay the bill on the table. Lost—no quorum voting. Ths question recurred on the passage of the bill and was lost for want of a constitutional number of votes—

The question being on the passage of the bill, it was decided in the affirmative. Ayes 32, noes 2. On motion of Mr. Emerson, the committee on county and township business was discharged from the considoration of the bill of the House regulating general elec-
tions.
The bill was then read the second lime. Mr. Berry moved to recommit the bill with instructions so to amend as to provide that the election for members of Congress shall be held at the general election in October, 1353. Mr. Dclavnn moved to lay the motion on the table. Lost—ayes 19, noes 19. The uuesrion being on recommitting with instructions, Mr. Winstandley called for a division of the question. Mr. Berry withdrew his motion to recommit with instructions and the bill was referred to committee on
elections.
Mr. Sleeth, from a select committee, reported that it is highly inexpedient to change the year of electing members of Congress. Not concurred in—ayes 18,

Mr^King moved to rcscina the resolution which authorizes the publication of absent members in the morning papers. Lost—ayes 34, nocs 43. file Speaker laid before the House a communication from the Door-keeper, stating that in obedience to the order of the House, he had taken in custody Mr. Gookins, who hod absented himself in contravention to the
rules of the House. Mr. Gookins said,
I have simply to say, in respect to the above proceedings, that on Friday, the 27th ult., I had, by vote of the House, leave of absence for an indefinite period. I had previously stated to the House, that in consequence of professional engagements, it would be necessary that I should have leave of absence, otherwise it would drive me to ibe neocsity of resigning my seat, ns I could not and would not oisregaref those obligation which I had previonsly assumed, f have had no notice that my leave of absenoo was revoked, and 1 insist that no such proceeding could he had to affect me in my altsence, and without notice to me. If this may be done, a member may always be violating the rules of the House without any possibility of knowing that he is doing so; a position so revolting to every sense of justice, needs only to bo stated to secure the ccndemation of every intelligent
mind.
I have only to say further, that every publication by any authority, stating that I was absent without leave, is contrary to the fact, and contrary to the journals.

The Speaker decided that it took two-thirds to pass the resolution, and hence it was lost. Mr. McDonald appealed from tbe decision of tbe Chair. t The question being whether the decision of the Chair shonld be taben as the jndgment of the House, it was decided in the negative—ayes 31, noes 45. Mr. Owen said that as there was a difference of opinion about the election of a Speaker, he therefore offered for adoption the following resolution: Resolved, That the H*»nse postpone tbe election of a Speaker until Monday next. Mr. Gookins said the House could do but one of two things, to proceed immediately to the election of a Speaker, or adjourn. Mr. Behm moved to amend the resolution so as to go into the election of a Speaker immediately; carried— ayes 45, noes 30. Mr. Huffstettcr moved to adjourn; lost—ayes 33, noes After some debate, Mr. Manson moved that the House adjourn; which was agreed to.
