GENERAL ELECTION LAW,

INCLUDING BRIBERY LAWS. An Act concerning elections, providing j enalties for the violation of the sam?, and repealing al laws in conflict therewith. [Approved March 6, 1889. j (Continued.)

Sec. 16. The Governor of the State, and two qualified electors by him appointed, one from each of the two political parties that cast the largest number of votes in the State at the last preceding gensral election, shall constitute a State Boaid of Electi n Commissioners. Stich appointments shall be made at least thirty days prior to each general election, and if, prior to that time, the Chairman of the State Central Committee of either of such parties shall nominate in writing, a member of his own party for such appointment,the Governor of the Sta e shall appoint such nomin j e. In case of death or disability of either appointee, the Governor of ths State shall notify the Chairman of the said Central Committee of such appointee’s political partv, and such Chairman may, within three days thereafter, recommend a successor, who stall the eupon be appointed: ’Provided, That if sum jjhairman shall fail to make recommendations of appointment within the time specifiod, the Goveanor of the State shall make such ppointment of his own selection from such political party. It shall be the duty of saidj Board to prepare and distribute ballots ana stamps for election of all officers for whom all the electors of the State are entitled to vote, in compliance with t e provisions of the election law. The members of such Board shall serve without compensation.

Sec. 17. In each county in the Stats, the Jerk of the Jrcuit Jurt and two persons by hfm appointed, one from each of the two political parties that cast the largest number of votes in the State at the last general election, shall constitute a Jounty Board of Election Commissioners. Said {appointments shall be made in all respects as appointments to the State Board of Election “ommiesioners are required to be made by the Govetnor of the State, except that the privilege of nomination shall belong to the Chairmen of the JZounty “entral Committees of the two parties aforestid. It shall be the duty of such Board to prepare and distribute ballots for election of all officers t be voted for in such coun y oth *r than those Who are tt be voted for by all the electors of the; State, in compliance with the provisions of this act. The members of such Board shall serve without compensation. Sen. 18. The said Board ofElectian Commissioners shail&cause to be printed on the respsetive ballots the names of the candidates nominated by the oonv.ntions of any party that cast one per cent, of the total vote of the State st the last preceding general election, as certified to said Boards by the presiding officer and secretary of such convention, or in case of primary election, by the chairman and secretary of any county or township committee; and also the harries of any cand : dates lor .my office when petitioned so to do by electors qualified td vote as follows: For a State officer, or any officer for whom all the el ctors of the State are entitled to vote, five hundred petitioners; for a Representative in Congress from any Congressional District, two hundred petitioners ;>for a county officer, member of the General Assembly, Jrcuit Judge or Prosecuting AttoTney, twenty-five petitioners; for an officer of a township, w«rd or other division less than a county, twenty petitioners. The signatures to such peiitio i need not be appended to one paper, but no petitioner shall be

counted, except his residence and post office address be designated. Such petition shall state the name and residence of each of such candidates; that he is legally qualified to bold such office; that the subscri! ers desire and are legally Qualified to vote for such candiates;and may designate a brier name or title of the party or principle which said candidates rrpres sent, together with any simple figure or device by which they shall be designated on the ballots. The certificate of nomination by a convention or primary election shall be in writing, and shall contain the name vs each person nominated, his residence and the office for which he is nominated, and shall designate a title for the party or principle which such convention or prim .ry election represents, together with any simple figure or device by whieh its list of candidates may be designated on the ballots; said certificate shall be signed by the presi.ling

officer and secretary of such convention, or by the chairman and secretary of the county, city or township committee, who shall add to their signatures their respective places of residence, and acknowledge the same before an officer duly authorized to take acknowledgment sos deeds. If the certificate of nomination of a y State convention shall request that the figure or devioa selected by such convention be used to designate the candidates of such party on the ballots for all elections thro’out the State such figure or device shall be so used until changed by request of a subsequent State convention of the same party. Such device may be the figure of a star, an eagle, a plow or some such appropriate symbol, but the coat of arms or seal of the State or of the United States, the national flag, or any other emblem common to the people at large shall not me used as such device. A certificate of such acknowledgment shall be appended |to suck instrument. In case of death, resignation or removal of any candidate subsequent to nomination, unless a supplemental certificate or petition of nomination be filed, the chairman of the State, county, city or township committee shall fill such vacancy. In case of a division m any party, and claim by two or more factions to the same party name, or title, or figure, or device, the Board of Election Commissioners shall give tiie prefeience of name to the convention held at the time and place designated in tbe call cf the regularly constituted party authorities, and if the other faction shall present no other party name, title or device the Board of Election Commissioners shall select a name or title, and place the same before the list of candidates of said faction on the ballot, and select some suitable device to designate its candidates: If two or more conventions be called by authorities c’aimed to be the rightful authorities of any party, the proper Board of Election Commis doners shall select some suitable devices to distinguish one faction from the other, and print the ballots accordingly: Provided, however, That if any political party entitled to nominate by convention shall in any case fail to do so, the names of all nominees by petition for any officer who shall be designated in their petitions as members of and candidates of such party, shall be printed under the device and title of such party on the ballots. as if nominated by convention. Certificates and petitions of nomination of Candidates for offices to be voted [for] by the electors of th' entire State shall be filed with the Governor of the State. Certificates and petitions of nomination of candidates for offices to be voted for by electors of any district or division of the State exclusively shall’ be filed with the Clerks of +he Circuit Courts of the counties or county included in or including such district or division. S ? c 19. If any Certificate or petition of nomination shall con-

tain the name of more than one candidate for any office to be filled, neither name shall be printed as a candidate for such office. If any person shall join in nominating by p titijn more than one nomi ue j for anv office to be filled, such person shall not be counted as a petitioner for either nomination. Sec. 20. The Governor of the State and the County Clerks shall cause to be preserved in their respective offices all certificates and

petitions of nominations filed therein under the provisions of this act for six months after the election for which such nominations were made. Sec. 21. Certificates and petitions of nomination filed with the Governor of the State, shall be filed not more than sixty days, and not less than twenty days, before the day fixed by law for the ele>* tions of the persons in nomination. Certificates and petitions of nomination herein directed to be filed with the Clerk of a county, shall be filed not more than sixty and not less than fifteen days before election.

Sec. 22. Not less than eighteen days before an election of the State to fill any public office for which all the electors are entitled so vote, the Governor of the State shall certify to the County Clerk of e ac h county the name and the place °f residence of each person nomi ua |;_ ed for sueh offices as specified in the certificates and petitions'of nominations filed with the G over nor of the State, and shall designate therein the deuce under which the group or list of candi dates of each party will be printed, and the order in which they will be arranged. Sec. 23. At least seven days before an election to fill any public office at which the electors of any county are entitled to vote, the County Clerk of such county shall cause to bs published in at least two weekly newspapers within the county, the nominations to office certified to him by the Goversor of the State, rnd also those filed with the County Clerk He shall make no less than two publications n each of such newspapers before election; one of such publications in each newspaper shall be upon the last day upon which such newspaper is issued before el setion.— Such publications shall be made in two newspapers representing the political parties that at the last preceding general election cast the largest number of votes in the State, if such papers there be: Provided, That in all cities where a daily paper is printed and published such notice shall also be published in two daily papers representing such political parties, if such there be. The lists of nominations published by the County Clerks shall be arranged, as far as practicable, in the order and form in which they will be printed upon the ballots and shall designate the devices under which t the group or list us candidates of each parly will be printed.
