The following incident Is related of Judge Horace Gray: A distinguished Massachusetts lawyer was once making an argument before him, aud when stating existing rules on his subject was peremptorily interrupted by the Judge. “Mr. , the law is so and so,” said he, giving the points as he believed them to be. “It is the law now. Your Honor, but it was not till you spoke," was the quick response. It is narrated that Judge Gray subsequently explained to the lawyer in graceful terms that he had spoken hastily. Indiana State oard of Health.
The following special rules have been adopted and issued by the State Board of Health: ▲ll “rules and regulations" of the State Board of Health are mandatory, and by the provision of the law “establishing a State Board of Health," etc., (See. 9) a fine of not less than $5 is incurred by any person who shall refuse or neglect to comply with the requirements of such “rules and regulations” each day of such “tailure or refusal,” after proper notification, constituting a offense. £The local Boards of Health throughout the State are hereby required to “promulgate and enforce” the rules herewith issued, and to enforce the penalty in case of “failure or refusal” of any person to comply with the requirements .hereof.
1. After January 1,1882, no person, until after they have been successfully Vaccinated, shall be admitted into any public or private school or institution of learning within this State, either in the capacity of matcher or pupil, and all persons admitted therein shall present to the principal thereof the certificate of some reputable physician as to me tact of their being successfully vaccinated. ~ 2. Itshall be the dut> of all unvucciuated persons within th s State to be successfully vaccinated within sixty days from Jan uai y 1,1882. And all unvaccinated persons uuiuiuginto this State shall be required to be vaccinated within sixty days after com ing into the Slate. 8. All children born within this State shall be succeesf ally vaccinated within twelve months after birth. All vaccination shall be with reliable bovine viius. By order of Board. Thad. M. Owing to the delay in the organization of the Local Board ot Health, paragraph 1, (circular Dj-special rule as to vaccination —is so modified that the health precincts where the Health Officer has not yet given notic£ to School Boards, Township Trustees, etc., as to the requirements of such rule, all Health Officers now or hereafter to be elected, are directed to give a proper written notice together with a copy of such rqies to each School Board, Township Trustee, and faculty of college (through its proper officers) that special rule as to vaccination, Paragragh 1 will be strictly enforced on and after thirty days subsequent to time of such School Board's etc., receiving such notice. For the purpose of vaccination, non-humanized virus, or that taken directly from the cow, fa the most reliable. Only in cases of emergency during the prevalence of smallpox, and where the non-human-ized virus can not be obtained, and where the iocal Health Board is satisfied and fully indorses in writing the purity of the particular virus used in any case can the use of humanized virus, obtained from the arm of a healthy child, oe Allowed. As further reason of this rule we< call attention to the fact that physicians are liable to criminal prosecution if bad results ensue from the use of vaccine virus that is not pure. In such health precinct, the health officer, will make provision for the free vaccination of all who, in their opinion, need such accommodation, so that none shall suffer for the want so a chance to obey the rule. Other paragraphs of the order of November 29, are unmodified and in fuil force. Uncalled for letters remaining in the Post Office, at Indiana, January 9th, 1882. if not claimed within thirty days from date above given will be sent to the Dead Letter Office, Washington, D.
