NOW comes the Plaintiff, by Yeoman Jt Douthit, hie attorneys, and flies his Complaint herein, together with an affidavit that the defendant Charles O. Willits is not a resident of the State of Indiana, and that he is a necessary party to said action. Notice is therefore hereby given said defendant. Charles O. Willits, that unless he be and appear on the first day of the next Term of the Jasper Circuit Court to be holden on the Third Monday of October, a. d. 1878. at the Court House in Rensselaer, in said County* and State, and answer or demur to said complaint, the same will be heard and determined in his absence.
