It is to be hoped that we shall hear no more about the duty of the secretary of the treasury to maintain the $100,000,000 gold reserve fund for the redemption of legal tender notes, of which ao many people haye been in the habit of speaking as “ established by law.” “created by law,” “a statutory requirement,” and the like. Researches made by Secretary Carlisle, in obed ience to a Senate resolution of inquiry, have resulted in these con elusions, which he lias communi cated to the Senate : “The Senate is respectfully informed that at no time since the establishment of the so called gold reserve has the sum of $100,000,000. or any other sum been segregated or set apart from the general cash in the treasury for the redemption • f tite legal tender notes of the United States, or for the redemption of any other form of paper money for which the United States is liable. There ia no provision of law requiring a separate fund or separate account to tie kept, and all moneys received int i the treasury, from whatever source, are deposited in tiie general cash.” And the secretary goes on to explain, that such a fund was, indeed, created by the secretary of the treasury, in the exercise of ids own discretion, in 1877 and 1878, and that it is once, but only once, mentioned in the laws of the United States. This once is in the national i bank act of 1882. Section 12 of that act speaks of the fund as ex- j isting, and provides, that when it] falls below $100,000,000, no gold | shall be taken by the treasury on deposit and certificates issued there for.
