AN ORDINANCE. Providing fit r the erection, construction, niaintaiiianee and opera- ■ tiou of a system of waterworks within the city of Decatur, Indiana for the purpose of securing an adequate supply of water for public and private purposes within said city, and granting the Decatur Waterworks Company the right to the use of the streets, alleys and public grounds of said city, for the purpose of sinking wells, laying and maintaining pipes and water mains, and providing for the conveyance of said system of water works to the said city by said company at she option of said city. Sec. I.—Be it ordained by the common council of the city of De catur. county of Adams, state of Indiana, that there be and is hereby granted tothe I lecatur Water Works Company, a -corporation organized under the laws of the state of Indiana, its successors and assigns, the right for a period of fifty (50) j years, to establish, maintain and operate a system of water works within and near thecityof Decatur, and for that purpose to enter upon, use and occupy all the necessary parts of the streets, alleys, squares and public grounds of said city, to sink wells, construct, lay, maintain, extend or repair water pipes, wells or aqueducts, within said city, together with such gates, hydrants, special and other fixtures and appliances, as are proper and necessary for the successful operation and maintainance of a system of water works for the public and private uses of said city, and persons, firms and corporations in or near the vicinity of said city, and the right to operate said system of water works. Sec. 2. —The granting to the said Decatur Water Works Company of the rights and privileges hereinbefore mentioned is on the condition that it shall commence the construction of said works on or before the 15th day of June, 1895, and on or before the 15th day of December, 1895, have completed and ready for operation to the satisfaction of and acceptance of the Common Council of said City of Decatur the said system of water works in accqrdance with the specifications approved by said Common Council, or by such persons or committee as the said Common Council may authorize; and also on the further condition that all the work in connection with the construction of said water works shall be under the supervision of and approved by the water works committee of the Common Council of said city. Sec. 3. —The company, or its as- : signs, shall not charge to the consumers, during the existence of the franchise granted by this ordinance, exceeding the following maximum annual rates; but it shall have the right at its will, at any time, to insert a meter into the service pipe of any consumer and to supply him at meter rates. The said city of Decatur , shall pay to the said The Decatur j ■ Water Works Coinpay, its successors and assigns, an annnal hydrant rental for the use of said ninety- j one hydrants and for the use of any additional hydrants directed to be erected by said city, at the rate of sixty live dollars ($65.06) per hydrant per year for the first six years, and at the rate of fifty - five dollars ($55.00) per hydrant pei pear during the remainder of the existence ot this franrhise, payable in semi-annual payments on or before the first days of July and Junuary of each year, beginning with the first day of January, 1896. Provided, That if the said The De'■•itur Water Works Company issue mortgage bonds, as hereinafter provided, to much of said hydrant rental as will be required to pay the semi annual interest on said mortgage bondsand provideasinking fund for the payment of the principle of said bonds when the same become due shall be set apart as a special fund by said city 6f Lecatur, and shall be payable by said city to the holders of said mortgage lionds, at the place where tiie interest and principal of said are by their terms made payable, ; and be applied to the payment of such interest and principal as the same become due, and for no other purpose. In case any additional public Hydrants shall be required by said city, the said water works company shall promptly provide such additional public hydrants at | any time on the request of said city or its legal representatives. The fire hydrants rented by said city of Decatur of the said compaI ny, or its assigns, shall lie used only for the extinguishment of tires and for testing of fire engines I and for practice of tire department and for flushing gutters and sewers ; through an open hose. The city shall have the right to use water for testing tire engines and for the practice of fire department, and also for finishing any sewers, whenever the Common Council or party authorized shall deem it necessary I for sanitary purposes, upon giving notice to the persons in charge of J said water works. In flushing, no ! oue hydrant shall be used beyond ja reasonable time iu each week, nor shall more than one hydrant opening be turned on at any time, nor shall any Hushing be done during the existence of a tire. The city shall have water free of charge for the use of the fire de- : partnient at the engine-houses, for the city hall, for the offices occupied for city purposes, for all public schools, for two fountains for drinking of beasts. Sec. 5. —For the purpose of constructing and building said waterworks the said The Decatur Water I Works Company may, at any time after the passage of this ordinance, issue the first mortgage bonds of said company to an amount not to exceed thirty-five thousand dollars I ($35,000.00), bearing interest at I the rate of six per cent perannum, and to secure the said bonds by a first mortgage or trust deed on the franchise, water works plant and property of the water works company, and may issue not to exceed eighteen thousand five hundred dollars (818,500,00) second mort gage bonds, bearing interest at the same rate, and to secure the said second mortgage bonds by a second mortgage or trust deed on the franchise, water works plant and property of the said The Decatur Water Works Company. The said The Decatur Water Works Com-1 pany shall make and negotiate said bonds to become due and payable as follows: The second mortgage bonds shall fie payable—s2,soo July 1, 1896; $3,000 July 1, 1897; $3,000 July 1, 1898; $3,000 July 1, 1899; $3,500 July 1, 1900, and $3,500 July 1, 1901. Sec. s.—lt is hereby made a condition of granting this franchise ■ that the city of Decatur shall have the right to purchase all or any portion of the capital stock of The Decatur Water Works Company, at any time, at a priqe not to exceed the par value thereof, and any ' time upon the purchase by said - city of all the capital stock under the provisions of this section, or whenever the said city shall ac quire in any manner all said capital stock, then in such case all rights, title and interest of said company in or to the said water works plant, including its franchise and all its property, shall at ■ once become vested in the said ■ city, and in such case it shall be i the duty of the directors and < f . fleers of said water works company ■ to make a conveyance or transfer ■ of all such rights, property and franchises to the said city; or the said city of Decatur shall have the further right and option to pur chase all the franchises, rights and property of said Ihe Decatur Water Works Company, at any time, at a price to be fixed by ; three appraisers, oue of whom shall be selected by the Common i Council of said city, one by said water works company, and the ■ third by the twoso selected. Ama • jority of the appraisers shall be . sufficient to fix such price. Provided, That in case such water works company shall have issued bonds for the construction and ex- ; tension of the said works and se ’ cured the rame by a mortgage or i trust deed on its rights, franchises and property, or any portion there- , I of, then and in such case said bonds and trust deed shall not be I affected by any of the foregoing I provisions of this section; but if • the said city shall purchase or be " come the owner of the said water works by the purchase or acquisi- • tion of the stock of the said company, as in this section provided, the right or title of the said city - shall be subject to the full payment of the bonds so issued by the said water works company and ■ i then outstanding, and also subject ■ to the payment of the hydrant rentals provided to be paid byl said city under the provisions of this ordinance, or so much of said i hydrant rentals as shall be suffi- , cient to pay the interest on and principal of said bonds as the same become due; and in such case said : trust deed shall remain and continue a lien on all the property, rights and franchises described therein, until the full payment of all the said bonds, both principal I and interest, and have the same force and effect as if the title to said rights, franchises and proper- • ty had remained in the hands of said waterworks company. Sec. 7 —This ordinance shall be in full force and effect from and after its passage, providing the same is accepted in writing, by said waterworks company in ten days from such passage by tiling with the city clerk its acceptance thereof. Berne. Rev. Xoah C. Kirschy of Watsworth, 0., preached Sunday at the Mennonite church. Wm. Baumgartner and Sam Simison went to Indianapolis Sunday night to see about the cost and particulars of putting in waterworks. Sprunger & Gerber have sold their build- . ing, occupied by the meat market, to Chris Gerber who will take possession on July 1. Robert Swartz has rented the tools and will be our butcher for the next five years. We wish him good luck. Sprunger & Gerber will move to Decatur soon. They intend putting up a packing house. Ed Proh sprained his leg badly last week while in P. W. Smith’s factory last week, Miss Mattie Zimmerman left for Bluffton Monday noon. John Schug is at home on a two week’s vacation. John reports trade very dull. On Sunday last our town was threatened with fire three different times. J. A. Hawk’s hoop factory caught fire and shortly after noon the stave factory and P. W. Smith’s mill. Help was close at hand each time and our town was saved from destruction. We are badly in need of a waterworks system. John Lachot is at home this week. Peter Ashbaucher was in town Tuesday day on business. Freeman Carlisle of Bluffton, and Jess Michaud drove to Geneva Sunday to view the ruins. On the return trip some fellows driving behind got tired of taking the dust and tried to pass them. As a buggy passed on both sides Carlisle’s horse got frightened and started to run, Carlisle being thrown out and quite scriotMly injured. Jess Michaud was also spilled out but escaped injury. The parties causing the trouble will feel the power of tfae law. Postmaster Welfley was at Indianapolis last Thursday.
