Notice Is hereby given that the Board of Commissioners of Adams county, Indiana, will receive bids for the construction of a macadamized road >n Washington township in said county, known as the Decatur and Monroe No. 5 Macadam Read, up and until 10 o’clock a. m, on Monday, September 7, 1908, at a regular session of said Board of Commissioners, held in the City of Deca’ur, Adams county. MACADAM ROAD PETITION. State of Indiana. Adams county, ss: Commissioner’s court, September term. 1908. In the matter of draining. grading and paving the cemetery road, in Washington township. To the Board of Commissioners of Adams County, State of Indiana. Gentlemen—The undersigned petitioners represent to your honorable body that they are ‘each resident householders and qualified legal voters of Washington townshiu. Adams county, Indiana: that they are each interested in the draining, grading and paving of certain highways in said township, including the one hereinafter described; that they desire that the following streets, parts of streets and parts of highways, designated herein as The Cemetery Road and beginning at the west end of Nuttman street, where it connects with the Preble Macadam Road (a free gravel road) thence east along said Nuttman street to where it intersects with Eighth street; Jhence south along said Eighth street to where it' intersects with Monroe street, thence west along said Monroe street to the corporate limits of the City of Decatur. Adams county, Indiana; thence continuing west along and over the Decatur and Bluffton Macadam Road (a free gravel road) which is a continuation of said Monroe street from the corporate limits of said City of Decatur, to the entrance gate of the Decatur Cemetery Ass’n and there to terminate; all in Washington township. Adams county, Indiana, be drained, graded and paved with brick, at the cost and expense of said Washington township. That said Washington township includes an incorporated city which has a population of less than 30,000 inhabitants and no incorporated city or town whic hhas a population of more than 30.000 inhabitants. That the said road above described lays wholly within said Washington township, and that the distance so sought to be drained, graded and paved is less than three miles. That the said road is now and has been for a long time, a public road and highway, and during said time has been opened to the public and established as a highway. That there is now and for a long time has been, a United States rural mall route passing over the said highway the entire length of the same as above described, and that there is now (and for some time has been) mail being carried and distributed to the patrons residing along said route. That the highway herein asked to be paved connects at the commencement thereof as above described with a free macadam road known as the Decatur and Preble Macadam Road and at its' terminus said highway connects with the Decatur and Bluffton Macadam Road, a free macadam road, and said highway, between the points named has several laterals running north and south and east and west therefrom, which are also public highways and are extensively traveled by the public. We would respectively recommend to your honorable body that the said highway be drained, graded and paved to the width of 34 feet, and that the said improvement follow the general direction as at this time laid -out and established. We would further recommend that said road be drained, graded and paved with brick with such sub-grade to the depth as the board may deem necessary. That the improving of said road will be of public utility, if improved as prayed for. We further represent that we have been compelled to and have employed an attorney to prepare and present this petition and have employed him to do such things as may be necessary in securing the necessary consideration of this petition, and we ask that he be allowed a reasonable fee for and on that behalf. Wherefore we pray that the petition may be granted, and that the said highway between the points named tbove be paved with brick, and that such paved part be established on a uniform width of 34 feet, that attorney’s fees be allowed in a reasonable amount, and for all other proper relief. We, the undersigned, each and all of whom are resident freeholders and voters of and in Washington township and in the City of Decatur, situated in said township,.in the county of Adams, and State of Indiana, do hereby respectfully petition your honorable body that you proceed to have a free macadamized stone road established, constructed and completed, in said Washington township over and along the public highway, situated on the following route, to-wit: Commencing at the northwest corner cf the southeast quarter of section six (6) township twenty-seven (27) north, range fourteen (14) eas - . at the Decatur and Bluffton Macadam Rpad. running thence west over the public highway there situated through the center of section six (6) township and range aforesaid, and endinc on the boundary line between Washington township and Kirkland township, at the northwest corner of the southwest quarter of said section six (6) township and range aforesaid, all m Adams county, Indiana. Y’our petitioners further show that said improvement is less than three miles in length and connects at the commencement thereof with a free macadam road in said Washington township, and that the same terminates and ends on the boundary dividing ashington township and Kirkland township aforesaid. Your petitioners further show that the improvement herein prayed for is to be a continuation of, and an extension of the Decatur and Bluffton Macadam Road, and this improvement is to be called the W. A. Bowman Macadam Road Extension. Your petitioners further ask your honorable body that said highway, above described, be graded, drained, and that broken stone be placed upon the grade, and that upon such broken stone there be placed stone screenings, and that there be built, made and constructed upon said highway what is known as a macadamized road. And your petitioners further show that the public highway thus sought to be improved, is a public highway, already established and is one of the public highways of said Washington township. Your petitioners further ask that said road as above described be graded to a width of twenty-four (24) feet, and that broken stone be placed thereon, to a width of ten (10) feet and to a depth of ten (10) inches in the center thereof, and to a depth of eight (8) inches at the sides thereof. And that crushed stone screenings be placed thereon, to a depth of three (3) inches upon said broken stone, and that said road be constructed as a double track. | We ask that said improvement be paid f< i by bonds issued by the county of Adams, in the State of Indiana, payable in twenty semi-annual instalments or series, and for the paynient of which we ask that a tax be levied upon the taxable property of said Washington township, and the City of Decatur, situated in said township in the county of Adams, and State of Indiana, in a sufficient amount to pay the interest tend principal of said bonds, as they may become due. That said road be built and con-I structed, and that said bonds be issued, and said tax be levied upon said property, of said township, in accordance with the acts of the legislature of the State of Indiana, passed in the year 1905, beginning on page 550, and as amended in the acts of the General Assembly of the State of Indiana, for the year 1907,, in the acts of 1907, and any and ail amendments thereto. We further ask the board that the proposed improvement herein be constructed without submitting the question of building the same to the voters of said Washington tfcwnship, and that the board take the different steps as required by law, to have said im- i prOvement constructed, as prayed for in this petition, and that they construct the same under and by virtue of the laws of the State of Indiana, providing for the extension of free gravel or macadam roads.
