COURT NEWS The February term of the Adams circuit court opened and Judge Erwin, the court oSßhals including Sheriff Butler, Clerk of the Court, Paul Baumgartner, Bailiff Frank McConnell and the various attor neys were present at the roll call—o— — Friend and Clell Eley, the two Berne boys, who did a wholesale business at stealing brass from off traction engines, a few weeks ago, appeared in court and plead guilty to petit larceny. Judge Erwin fined each of the boys five dollars and sentenced them to a day in jail. The boys mothers were with them and paid the fines. The youngsters are bright looking little fellowss and the lesson should do them good. Attorney J. W. Teeple repr renting James E Mosure Friday evening filed five suits against Arthur E. Rose and others. The five suits aggregate <1390.35. The notes are secured by various business men. —o— The Willshire Canning company through their attorney, Shaffer Peterson, filed a suit Saturday against Sheriff Albert Butler, to replevin a Sprague oornoutter valued at <3OO, and which said Sheriff Butler has advertised for sale as part of the Berne Canning company. <IOO damage is also asked for. According to law Coroner J. S. Falk served the pipers upon Sheriff Butler. ________ The case against H. P. Sellsand Howard Davis, larceny, was set for trial Monday, February 20th. C- Moran and C- JLutz Monday tiled a partition nit against her husband. Joseph Osborne, who is serving a life sentence for the murder of Mrs. Osborne s father, John Buaenbark. The complaint says that Mr. and Mrs Osborne jointly own the east half of the southeast quarter of the northeast quarter in section 30, Union township; that same cannjt be partitioned and the court is asked to appoint a commissioner to sell the property. EXPLOSION AT MONTPELIER. Montpelier, Ind., Feb. 4.— (Special).-A terriffio explosion occurred on the Spaulding farm two miles north of here on the Wells county line at nine o’clock this morning, when a jumbo gas burner , set tire to a nitro glycerine factory 'owned by the Empire and ' American Glycerine company. The build ing was completely demolished and a hole of large dimensions torn in the ground. Two men I were injured but not seriously. No one was in the magazine at i the time of the explosion. Fr d Bain was w irking in a power house 500 feet away. The building was torn to pieces and Bain was in- , j tired bv the falling timbers John ' Sootr was pumping an oil well, 300 ; feet from the magazine. He was hurled fifteen feet and quite .badly bruised. Both men will recover. The magazine contained 2,250 quarts of the deadly explosive. The shock was felt and the report heard for forty miles in every direction. Windows in the immediate neighborhood were shattered and slight damage done'to homes m Montpelier. The scene of the expolsion was over thirty miles from Decatur, bur the report was heard plainly bv many people here. SCHAFER MURCER CASE. Bedford, Ind. Feb. 6.—Justice McLahlan rendered his decision in the Evans-Browning matter today the defendants being charged with the murder of Miss Sarah Schafer, the school teacher, in this city a year ago. Evans was released, while Elmer Browning was remanded for grand jury action. Ta e grand jury will meet on the 2<ith inst. The court hor.’e was crowded to its utmost capacity at the time the justice made public his ruling, and Frank Evans and his friends expressed their gratification by loud demonstrations, the released prisoner stepping forward and heartily shaking hand* with the court. The verdict seems to meet the approval of only a part of the community . The closing of the preliminary hear ing of Browning and Evans and the . decision given by” Justice leave the murder of Miss Schafer, the high sc bool .teacher as much a mystery as it was thTmorning'after the young woman’s body was found in a cab shed at this city, more than a year ago. Many persons believed that Justice McLahla vould hold both Browning and Evans to the grand jury, while”the friends ofjthe prisoners were confident he would release" both~men, and the decisioiTof the justice - was a surprise to the prisoners and their friends and to the prosecution.
