The different counts are similar but each alleges the crime to have been committed in a different manner, the proving of any of which will lie murder. Mr. Moran stated that the evidence will show that Osborne is about thirty five years of age, that Busenbark was sixty five years old and feeble; the evidence will show the life of the two men previous to ’their coming to Adams county as well us showing their troubles after coming here and the story of the awful crime, of September Bth, last; the evidence will show that Osborne and Busenbark quarreled some, that the crime was committed at the east side of the barn on the old Julius Hougk farm. Busenbarkj and Osborne came from the house. | the former sat down on a plank that pertruded from the rear of the wagon. Osborne came up to him and spoke about disposing of their farm by taking the question to court -when the old man replied, “Why dont’ you take it to court,” that then Osborne knocked him down, pounded his face until Ira Richards, the hired man who had witnessed the affair took him off Osborno went to a pump and washed. A little son of Osborne had seen the attack and his screams brought Mrs. Obsorne to the scene, who found her father lying unconscious, his throat black ; from finger marks, the face mashed, jaw bones broken, the face cut and mangled. Mrs. Osborne and the hired man tired Mr. Busenbark as comfortable as possible by placing hay under his head. At this time it is said Joe Osborne said: ‘ If I had hel l may temper, this wouldn’t have happened.” Shortly aft rv ird the injured man was j t aken to the house, where he died j t he following day. Blackburn went out to subpoena Busenbark and there found the true state of affairs. Obsorne was then taken to jail. Mr. Moran sail the evidence will show that Osborne murdered Busenbark, that it was premeditated and with malice forethought. He also said we will show that Mr. Osborno was a man of sound mind and u moneyg’maker before coming to this county, as well as after he] came”here. We will show all these things and will demand a verdict of guilty of murder in the first degree at your hands. It is seldom that a murder r d is heard in Adams county, at least j one of so much intore-t or impor-j •fence as the one now on in the! A lams circuit court and for that i reason we believe [that every! speck of news available will be i-ead by our many readers at thisj time. We give therefore a list of I the jurors and a word of each j who are hearing the evidence in the famous Osborne case: Theodore Beerbower, is thirty* eight years old, a prosperous young farmer of Jefferson township. O. J. Human, is forty two years old lives in St. Marys township near Pleasant Mills, this farmer has been in business. Joseph L. Hook, is forty five years old, lives in Blue Creek township, and is a well known farmer. James D. Gault, is fifty years old, a popular farmer of Kirkland township. George Keller is fifty-one years old, a Root township farmer. Jesse Roe is twenty five years old and hails from St. Marys township, where he is i knwon as a hustilng young ’farm-j er. James Duff is forty seven, years old. lives in Jefferson town-! snip, and is ono of the best i known men on the jury. Ernst! Doehrman is twenty six years old. i and lives in Preble township, he is a brother of the well known restaurant man here. George
iacxm.u, forty-eight years old is a Root township f irmer. Samtel Shell of Kirkland township is ‘he oldest of the furors, being fiftvnine. Vernon Pontius lives near i Geneva and is but twenty-thru ! years old, the young ‘st of the i jurors. In his examination bi ! said he had never heard of tb< | nurder until summoned a« a to” lor. He is an oil man. Uncle Dan ■ Kitson is fifty eight years old. lives •in this city and everyone knows , iitn. He will keep the jury in good I humor during their imprisonment ; From this it may be seen that the Idest juror is fifty nine and the mngest t venty three, an averagi ■f forty three. Eight townshipire represented, there being met toitn every one but Hartford. F ' -nch. M inron and Union. The jruors are a well selected lot of men who answer every oualification and will do their duty as they see and believe it. Ninety three men were called and eigthy four were actually examined the other nine being excused for some reason or other. HEARING OF EVIDENCE. IRA RICHARDS—Lived in Preble, for two months. Prior to that ! time lived on Osborne-Busenbark j farm in Union township, before that lived in Grant county, four miles ! from Point Isabelle, work by day, knows defendant, met him lust February in Grant county, employed by Osborne at 75 cents a day came here March 3, 1903, with Osoorne, met Busenbark at same time he did Osborne. On the farm we moved to where two houses, 1 occupied one and Osborne and Busenbark the other. Began work March 10 ana built October 14. On SeptemOer 8, was hauling manure east of barn. Busenbark was home in the morning and at Decatur in afternoon, arriving home about three o’clock. During afternoon Osborne I was busy with 8. W. Peterson, a ■ hay baler. Saw Osborne and Busenbark come from house to barn near where I was loading manure, they olimoed over fence, Busenbark stood up on fence and pulled his coat off, then came over and sat on a board that projected from rear of .wagon. Joe came up and said “If the farm ’aint worth $75 an acre and yon wbn’t give that for it, ! why not leave Judge Erwin have it” I and Busenurk said, “well, sell.” , Joe asid ‘ I ll take it to court,” ,the ' old man said alright. Osborne said, I “you brought me here to get me in ! some kind of a snap and you think I you’ve got me,” then Joe struck the old man in the breast. He slid off his seat, struck at Joe twice hut didn’t hit him. Joe began beating the old man and kept it up until I got there and took him off. Joe wont to the pump, washed blood off. Joe rau-t have struck him five or six times. Mrs. Osborne came then. Dale Osborne was there and cried. Mrs. Osborne began rubbing fathers face, I went got hay and put under him, he was lying on the manure pile. I went to Mrs. Walters, a neighbor and told her to telephone for a doctor. Elijah Walters and Mr. Roop came with me. Joe was standing by barn. Mrs. Osborne was with her father. We carried Mr. Busenbark to the house. On the way he strangled and emitted a quart of blood. Dr. Clark came soon. I saw Joe and told him to go to town and consult someone who knew more about law than me. Next saw Joe in jail, told me he was sorry, asked about wife and said, 'How on earth can she stand it.” Have seen him there ! three or four times since. When coming to town at Clover Leaf station Joe complained of roads and Busenbark joked about the matter and Osborn said if we can’t agree we can disagree. He heard Osborne say to Busenbark,“if it hadn’t been for you my trouble in Grant county wouldn't have cost me a $lO bill. They quarreled once about a sow. Osborne is about 35 and Busenbark was about 68 years old. Cross examined by attorney Smith, Mr. Richards told his story over about the same as before. He is an earnest looking young man and told his story in a modesty.ind convincing manner. In cross exaimnation Mr. Richards said that Osborne’s face had no color in it and his eyes were trlaring,*vhile Mr. Busenbark was seated on the wagon he had a small black handled knife in his hand. As ho struck at Osborne he tried to
speak bur thoi«oiind wa< no word simply being, “Gur.” Court adjourned at 5:30. The jury was placed in charged of a new bailiff, John B gner, who will have charge of them during the trial, O. N. Tyndall having suffered a nervous chill and was forced to resign. Prisoner Osoorne was in his accustomed place in the court room Thursday morning a half hum b tfoi e court convened at nine o'clock. His face is not as pale as at his first appearance and negins to look more like his old self. Ira Richards who was on the stand last evening was again called and attorney Smith resumed his cross examination, again going over the conversation which took place just before the attack. On re-examination Richards described the coat which Busenbark hud on, saying it was a thin; linen scat, again went over part of the story and said that during other quarrels he had heard Osborne nad appeared to be angry, said Busenbark died following day after assault, saw him after he was dead, he was a large man, six feet tall and would weigh 180 pounds, attended the funeral, remembers coroners inquest. After short re-cross examination, witness was excused. LETTIE SCHNEPP Lives in Union township, wife of Soloman Schnepp knew Osborne six months, lives quarter of mile east, w.is at home Sept 8. Went to Osborne home about four o’clock when she heard children screaming. Saw Mr. Busenbark lying on ground east of barn. Mrs. Osborne

was there washing her father’s face. Joe was standing near. I carried water to wash Mr. Busenbark’s face, his face was swollen and cut and eyes looked like they had been knocked out. Joe came up and said“WtJut temper will do.” Went home, came back next day, saw Mr. Busenbark just when he died, a few moments before four o’clock Sept. 9. Cross-exam inationed and told the same story. FRAXK ROOP. Lives in St. Marys township, farmer, knows Osborne, lives mile and three quarters away from Haugk farm, was also farming part of Walters farm near Osborne. On Sept. 8 was there, saw Osborne day before, went to Osborne's about four o'clock afternoon of Sept. 8 when Ira Richards came after men, and my boy, Lige Walters came soon; saw, Mrs. Osborne, two boys and Joe was standing in horse field, saw Busenbark lying nearby and he was bloody (Continued on page 3, first column ) ...Legal Advertising...
