Mrs. Abigal Mannesmith, who for fifty years has boon a resident of Preble township, died at three o’clock Friday morning as the result of a iM'culiar accident,® She has been staying at the home of her daughter, just over tlie line in Wells county vmd fell out of j bed. She suffered great pain* until yestenfay morning when she sank into unconsciousness and never rallied. She grew steadily worse until this morning when the end came. Shortly afterward the grand jury returned an indictment against ’’Reynolds on a charge of kidnapping. He was tried during the February term hut the jury failed to agree and a new trial this term was necessary result. The east* was tried before Judge Smith. John M. Smith of Portland who gave his charge a few minutes before six o’clock and they were sent to their room. The first ballot resulted eight for conviction and four «for acquittal tlie next ballot one went over to conviction and the next still another, then for fifteen ballots they stood ten to two. At three o’clock Thursday morning they agreed and returned a sealed verdict which was read as above at nine o'clock in open court. Attorneys for the defendant notified Judge Smith that they would ask for I new trial. The verdict caused quitii a stir about the court room for a few minutes this morning. The penalty will lx* fixed by the judge unless <t new trial is grant®! and will be an imprisonment of from two to fourteen years in the Jeffersonville reformatory and a fine of from $1(H1 to *5,000. Prosecutor Moran conducted the case in ga vigorous manner, being ably assisted by Messrs. Erwin & Erwin. |
