The supreme court lias decided j that the act of the last legislature authorizing the serving of notice of an appeal on the attorneys instead of appellees is unconstitutional. The matter grew out of the case of Mary O’Mara vs. the Wabash railroad Co. in which she sought to recover damages in the sum of SIO,OOO for the death of her husband, a freight brakeman. O'Mara died from the effects of injuries recieved at Logansport where he was caught between a freight car and a telegraph pole. She lost in a lower court in Tippecanoe county and her appeal was dismissed because the appellee was not notified.
