Maddox was directed late Wednesday to appear at a hearing next Thursday to show cause why he should not be cited for contempt for refusing to obey an earlier federal court injunction directing him to admit Negroes to his fried chicken restaurant. One of Maddox’s attorneys. William O. Mcßae, said today he had advised the flamboyant segregationist "that he should not violate the injunction.” Mcßae said Maddox repeated his often declared Intention to close rather than serve Negroes. Maddox quietly accepted the summons from a federal marshal in his restaurant, the Pickrick, where he turned away five Negroes Tuesday. "The Justice Department is very foolish to waste its money on this sort of thing,” Maddox said to newsmen. "I haven t violated any court order. “They havei no grounds for such a suit unless they use lies or half truths.” The suit was based on an affi- ' davit by one of the Negroes turned away from The Pickwick, which specialized in fried chicken. Maddox was ordered by a threejudge federal panel to begin serving Negroes without discrimination on Tuesday. He has appealed the decision to the U. S. Supreme Court in the first test of the new civil rights law, but lost a bid to stay the desegregation order until his case is heard.
