FOUR OF ZONING j (Continued from Page One)— a welding shop from a home on the south side of Adams on the i east side of the Pennsylvania railroad, asked that his welding repair shop be left zoned as industrial. This shop is presently industrial, but is adjacent to an old established residential district, and'within a few feet of a home. It would be the only industrial spot on the east side of the railroad at that spot, making it a spot industrial site. Sheridan recommended, and the board concurred, that the property be zoned residential. This would allow him to continue his welding shop, but he could not expand it or change it. Also, it violates other sections of the present zoning ordinance in certain aspects, such as bright light, odor, etc., near a residential area, specifically forbidden in the ordinance. Arthur Franz’ motor repair shop on St. Mary’s between Fifth and Third streets, appeared to object to the increasing use of the R-l area for business uses. Bixler testified that Franz originally in 1949 had not operated his business from his garage, but that later than 1953 started using it; that it has increased in tempo greatly that time, and is a neighborhood nuisance. The board explained that it was Illegal to expand or enlarge the business, but that the board of zoning appall s had ruled on the mattfer a. few years ago; "Roop stated he would check the record. Bauman Upholstery William Bauman then appeared and asked that the lot beside his Upholstery Shop on Monroe street be zoned general business. Now just half of the lot is zoned business. This was taken under advisement. then brought up later at the meeting, and it was decided that that side of Monroe to the alley, and the area across the street to the alley, including one small lot on Seventh street, be changed to general business also. Strickler Trailer Decatur attorney Lewis *L. Smith then, appeared for ' Paul Strickler Trailer Sales, and asked that the lots 123 and 124 north of Eiting's lots oh the west side
> of 12th street be zoned for business, and this was approved as requested. Joe Murphy, former city councilman, appeared and asked if the north and south sides of Monroe between 12th and 13th streets were going to be zoned local business, from residential, and the board said yes, they had had no objections. The west side of 13th street from Monroe to Adams, and the east side from Monroe to Worthman field, were also zoned local business. , ’ Body Shop Charles Leonard then appeared, and asked that the lot on which he has his body shop, on an alley between Elm and Spencer at the Pennsylvania railroad, be left industrial. In the meeting later, this request was granted, since the lot was an island off the street which was largely changed from industrial to residential. The question of zoning on highway 224, Nuttman, was brought up, and it was explained that the lots within two lots of 16th street are to be zoned B-2 local business. All of the Mies lot across the way was zoned general business. ■ Pass Ordinances When all of the problems had been discussed, James Cowens, board vice chairman, acting in

the absence of the chairman, accepted a motion from Carl Gerber to adopt the proposed ordinance as amended, and to certify them to the city council, as required by law. This was seconded by Lawrence Kohne, and approved unanimously. Hal Teeter was also absent. Anyone questioning any possible action, or desiring to see all of the proposed changes, should look at the map in the city engineer’s pffice as soon as possible, Sheridan Counseled. Still May Be Heard The council will receive the i ordinance at its next meeting, i along with an ordinance, passed ■ at the same time by the commission, for an improvement location permit, at its next meeting, May 5. Mayor Gerber stated that he probably will not ask that it be passed at that time, because the election night meeting is usually short, and it will take quite a long time to read the ordinance. Anyone still objecting should appear before the council, however, as changes are easier to make now than later. The council will then • pass’ We ’ ordinance, except for any changes; the changed sections will be referred back to the plan commission, and if approved will im-
mediately be law; if not, they must be passed by a three-four ths vote of the city council to become law. If the city council fails to act within 120 days, the ordinance becomes law as proposed. A proof of publication of notice was read and approved, and the board adjourned. The next regular meeting is planned for July. Remedial Reading Program Offered A tuition free remedial readies program will .be offered in summer school for children in grades three through eight this year, it has been announced by North ■ Adams school officialis. One-hour classes five mornings a week, will begin June 1, and continue for eight weeks. All classes will be conducted at Northwest elementary school. There will be a book rental fee. The only fee will be that of the book rental, but parents must furnish their own transportation for their children. Anyone interested in entering a child in this program is asked to have the_ child pick up a registration blank from ine office pf his school. The blank should be returned to his, or her, principal before May 19. Further notices of when classes will begin, .etc., will be forthcoming. Driving Privilege Ordered Suspended The driving privilege of Delmar C. Orme. 610 Line St., has been suspended, according to the latest driver suspension list issued by the bureau of motor vehicles. — Orme’s suspension is for sixmonths, for matters appearing on record. It runs from March 24 to September 24, of this year.

Ruby Attorneys Ask Sanity Trial DALLAS (UPI) — Jack Ruby, said by his psychiatrist to be suffering delusions of the massacre of Jews outside his Dallas County jail cell, almost certainly will go before a jury to determine if he is insane. Lawyers for the condemned killer of Lee Harvey Oswald filed a motion Monday for a sanity trial for him, and Asst. Dist. Atty. William F. Alexander said the judge has to grant it. Judge Joe B. Brown said he would set a date for the trial later. Ruby nursed a bruise on his head received when he rammed the wall of his cell in an apparent suicide attempt Sunday, the same day he was caught trying to make a noose out of his white jail uniform. Ruby’s lawyers, headed by Dr. Hubert Winston Smith, a combination lawyer-doctor, lost an attempt Monday to get the baldish, and haggard former strip t ease club operator removed from jail for prolonged mental tests. If Ruby gets a sanity trial and the jury finds him insane, he would be setnt to a state hospital for the criminally insane, and all appeals of his death sentence conviction would be suspended until he was cured. If the jury finds him sane, he will stay in the county jail while the courts consider his appeal.
