Jack Ruby's Trial Will Open Monday DALLAS (UPD — Selection of a jury in Jack Ruby’s murder trial gets under way Monday in Dallas, but defense lawyers today vowed to grill jurors just short of insult and defamation to prove a fair trial here is impossible. Criminal Dist. Judge Joe B. Brown ruled Friday he would check the “tenor of the jury” before making a final decision on the defense’s change of locationrequest. He said the “true test” of whether a fair trial could be staged in Dallas would depend on the ability to seat a jury. Ruby is charged with killing Lee Harvey'*Oswald, President John F. Kennedy’s accused assassin. The defense said Dallas citizens feel the city — scene of both slayings — is on trial instead of just Ruby. “We are going to ask each and every juror every sort of question this side of insulting them and defaming them,’’ chief defense lawyer Melvin Belli said, “in view of the fact we have failed to get fair treatment. A conflict between defense lawyers was revealed Friday night. J. J. Tonahill, of Jasper, Tex., Belli’s chief assistant, said that Tom Howard, the first attorney retained by Ruby, had withdrawn from the case “because he hag a daughter who is ill.”
