Propose Televising Os Ruby’s Trial
WASHINGTON (UPD — The proposal to televise the Dallas trial of accused slayer Jack Ruby today recalled statements by top federal jurists condemning such coverage. Ruby has been indicted on a murder charge in connection with the fatal shoofing of Lee Harvey Oswald, alleged assassin of President Kennedy. He will, of course, be tried in a Texas court not a federal court. Texas and Colorado are the only states which leave the question of televising or broadcasting trials up to the presiding judge. The judge scheduled to preside at Ruby’s trial. Judge Joe Brown, has not yet decided What coverage to permit. In 1962 both the Judicial Conference of the United States and the American Bar Association strongly disapproved of televising trials. “Right to Know” The argument in favor of broadcast coverage is that the people’s“right to know’’ is basic to American liberty. Therefore, the greater th6 scope of coverage, the better the public will understand how justice is administered. In addition, the Sixth Amendment to the Constitution guarantees the accused a “public trial.” » In 1960, at the University of
Colorado. Supreme Court Justice William O. Douglas devoted an entire speech to answerine these arguments. “It is a ‘public trial’ that the Sixth Amendment guarantees” he said. . but this guarantee is for the benefit of the accused, not the press . the concept of the public trial is not that every member of the community should be able to see or hear it. Trial Is Open “A public trial is one that is open rather than closed—a trial that people other than officials I ..can attend. The public trial ex- • ists because of the aversion I which liberty-loving people had toward secret trials ... that'is’ the reason our courts are open to the public, not because the ' framers wanted to provide the 1 public with recreation or with ’ instruction in the ways of government.” —-—? — Referring to television, Douglas said: J. ■ - “The already great tensions ■ on the witnesses are increased when they know that millions of people watch their every expression, follow each word. The presence and participation of a vast unseen audience creates a i strained and tense atmosphere that will not be conducive' to a quiet’ search for truth."
