Civil Rights Issue In Elections Today
WASHINGTON (UPI) — The grass-roots political impact., of the Negro civil rights “revolution” gets its first major assessment today in’off-year state and local elections across the nation. The racial controversy was particularly in evidence in .the spirited contests for governor conducted in Mississippi and Kentucky, and in Philadelphia’s mayoralty election. Theresponse, to the Negro demands was not of major concern to most political .strategists; it was the reaction of the white majority to those demands that was thought to provide a clue to 1964’s general election. « In Mississippi, » where both candidates are ardent and outspoken segregationists, the civil rights issue took an odd twist as the Republicans made their first serious bid since Reconstruction to capture the governor’s mansion. Lt. Gov. Paul B. Johnson, a Democrat, was still favored to win but Republican Rubel Phillips, a handsome young admire er of Sen. Barry M. Goldwater, R-Ariz., made a race of it. Johnson was backed by outgoing Gov. Ross R. Barnett, who is barred by law from suc-t _ceeding himself, and some or the biggest names in Mississippi politics. Phillips claimed he would have stood stronger than Barnett against the adminission _.Qf_Negro James H. Meredith to the University of Mississippi last year. — The Democrats were also favored to win the guvernatorial race in Kentucky where Republican Louie B. Nunn opposed Democrat Edward T. Breathitt Jr. But here again the Democratic margin was expected to be smaller than in recent years. In Kentucky the civil rights issue centered on the executive order issued earlier this year by retiring Democratic Gov. Bert Combs. It forbids racial discrimination in all business establishments licensed by the state. Nunn Attack Order Nunn- hit hard at the order, not on racial grounds, he said, but on constitutional grounds — a pbsition somewhat similar to that of Sen. Goldwater. He also attempted to link Breathitt to the Kennedy administration. Breathitt, a protege of Combs said he would leave the matter of the executive order up to the legislature. He scarcely mentioned the Kennedys, except to say that none of them is running for governor of Kentucky. If Nunn, who started the campaign a definite underdog, should upset Breathitt in a state where Republicans have occupied the executive mansion only four times in this century, his attack on Combs’ executive order and his use of the “Kennedy issue” will get most of the credit. Philadelphians, divided by explosive racial tensions, vote on whether to give Democratic Mayor James H. J. Tate his own four-year term or turn the Democrats out of office for the first time in 12 years in favor of Republican James T. McDermott. Tate. who became mayor when Democrat Richardson Dilworth resigned to run unsuccessfully for governor against Republican William W. Scranton, ran with the backing of Rep. William J. Green Jr., city Democratic chairman, and the on-she-scene endorsement of President Kennedy, who made a special trip to Philadelphia lastt Wednesday. Racial Issue Arises Both sides attempted to play down the racial issue, but the explosive local situation which has resulted iu a series of disturbances during the last few weeraTforced it into the camMcDermott charged Tate with giving in to Negro pressures all along the line. Tate accused McDermott of trying to squeak into office by capitalizing on white resentments built up »through recent Negro gains in employment, housing and education. i Purely local issues dominated most of the rest of the hundreds of state, city and county elections across the nation. In New York City, voters were to register their opinions on a controversial proposition concerning legalized off-track horse race betting. The proposal, championed by Democratic Mayor Robert F. Wagner and hotly opposed by Republican leaders of the, State Legislature,' would allow the mayor to appoint a committee to draw up a plan for legalized bookie parlors jn the city. Propane Gas Thought Cause Os Deadly Blast INDIANAPOLIS (UPI) t- Investigators say propane gas probably caused the Halloween Coliseum explosion that killed 68 persons, but they do not know what ignited it. » “Nothing we heard has made us change our mind that a propane gas explosion,” probably in the commissary, rocked the Coliseum, Bernard Sweeney, chief investigator for the Indiana State Fire Marshal’s Office, said after Monday’s 10-hour hearing. But he said it was an explosion “from factors unknown.” Sweeney said there was “no definite evidence” that indicated a rupture or leak in the five liquid petroleum gas tanks which were impounded from the tons of debris inside the Coliseum. The five tanks were to be sent to Purdue University today for examination. Sweeney said “perfunctory” examination failed to show signs of defect. Sweeney said “several witnesses” told of seeing what “matured into an explosion” last Thursday night, while a crowd of 4,600 persons was watching the “Holiday On Ice” show. He said the witnesses used such words as “vapor,” “fog,” and “steam” to describe the circumstances. But he said there was no indication that anyone was touching the tank when the vapor or fog was first seen, and the tank was upright. The last witness, Cecil Lonas, Indianapolis, a part-time employe at the Coliseum, told reporters after the hearing that he saw smoke coming from the tank. Lonas said all he knew was that “Shorty” (Wilbur Gaither) said something about gas, and they ran out. The men were working in the commissary, a pit area under the stands where the food is prepared for the vendors. No hearings were scheduled today because of Indiana’s mayoralty elections. . After hearing 11 witnesses, Sweeney said investigators “can't place anything else at the scene of a highly combustible nature except, propane gas.” Others recovering from injuries and burns were scheduled t<s be interviewed in hospitals. Meanwhile, the first damage suits resulting from the explosion were filed Monday. Mrs. Carolyn Ann Foster*26, sought $450,000. Mrs. Sarah F. McCoy, 60. also Indianapolis, sought $50,000. Both were injured in the . blast. Named as defendants in the suits wei*e the Coliseum Corp., Coliseum manager Mel Ross, the Discount Gas Corp., the State of Indiana, and the Indiana State Fair Board. Berne Girl Member Os School Orchestra Sherry! Anne Zerkel, daughter of Mr. and Mrs. O. K. Zerkel of Berne, has been appointed to membership in the civic symphony orchester at Manchester College. North Manchester, according to the college department of music. Miss Zerkel is a graduate of Berne-French high school and a freshman this year at Manchester College majoring in elementary education. L. Luther Yager On African Hunting Trip Former state representative* L. Luther Yager, of Berne, left this morning for Gabon, Africa, on a big-game hunting expedition. He will fly from New York to France this afternoon, visiting with the Marc duLac family in Arles several days. The two will then fly to Gabon for two weeks of hunting and visiting missionaries in the area. Ten years ago duLac was ’a Rotary exchange student in Berne.
Christmas Mailing Dales Announced Decatut postmaster John Boch today announced that the period November 1 to November 20 has been designated for the mailing of Christmas parcels by surface transportation to members of the armed forces overseas. The period for air mails is December 1 to December 10. Greeting cards for the armed forces overseas should be mailed within the periods designated for parcels if they are to have a reasonable expectation of delivery prior to Christmas. All articles should be packaged in boxes of wood, fflbtal, solid fiberboard or strong double-faced corrugated fiberboard. All fibreboard boxes should be securely wrapped in heavy paper which materially strengthens the package. Each box should be well tied with strong cord. , Unless completely packaged and tightly filled, boxes are likely to be crushed. Sufficient cushioning material should be used to prevent any rattling or loosening of articles within the package. A slip showing list of contents and addressee should be enclosed in the package. Boch also said that Christmas packages and cards for distant states should be mailed early. Packages for distant states should be sent befordor during the week of December 2-7 and greeting cards should be mailed not later than December 10. Local delivery packages should be mailed not later than December 14 and local delivery greeting cards not later than December 15. Valeo Is Named As Senate Secretary WASHINGTON (UPl)—Francis R. Valeo, a mild-mannered scholar from the big city, was elected unanimously by Senate Democrats Monday to succeed Robert G. (Bobby) Baker as their majority secretary. Baker resigned the $19,600-a---year post Oct. 7 when his wideranging business ventures came to light. The Senate Rules Committee presently is investigating ,to se§ whether conflict of inter- .. est laws were violated,. If the senators were looking for an opposite type to succeed Baker they found him in Valeo. The 35-year-old Baker, came out of the hill country of Pickens County, S.C., and learned - his politics in the Senate cloakroom from the time he was a 14-year-old page boy. Valeo is a 47-year-old native of Brooklyn, N.Y. Unlike Baker, he is almost shy and his political knowledge is mostly academic. He took a degree from New York University; and developed his academic speciality —Asia—while serving in the China-Burma-India theater during World War 11. After postwar graduate study, Valeo joined the Library of Congress foreign affairs department as an Asia specialist. He soon met Senate Majority Leader Mike Mansfield, D - Mont., also an Asia specialist. Valeo was later loaned to the Senate Foreign Relations Committee, then went to work for Mansfield as his assistant in 1959. 1 Valeo was named to his new post shortly after Baker resigned. Frankfort Resident Dies Os Gas Fumes FRANKFORT, Ind. (UPI) — Clinton County Corner Dr. Luther Hartman said today Dale H. Wright, 42, died in his apartment Monday when he was overcome by fumes from a gas space heater that was not properly ventilated.

Rescuers Work To Reach 11 German Miners "PEINE, Germany (Ut 3 !) — Rescuers worked today to complete the perilous breakthrough of an escape shaft to the crumbling underground cavern where 11 men have been trapped nearly 12 days in a flooded iron mine. Engineers cleared debris from the shaft, completed to a depth of 130 feet, so they could line it with steel pipe and cautiously drill the final 52 feet. Breakthrough was not expected until sometime Wednesday at the earliest and rescue officials said it might be Thursday before the men were brought to the surface. Lower Food, Drink Imprisoned in a watery chamber measuring 9-by-12 feet, the men have been kept alive by food and drink lowered through a narrow communications shaft since their discovery Sunday night. , They shared the watery chamber with the corpses of 10 comrades killed by rockslides. The 11 men were the last known survivors of the 129 working in the mine when a sedimentation basin on the surface collapsed Oct. 24, dumping 19 million gallons of sludgefilled water into the mine. A total of 89 men escaped or were subsequently rescued. Hope of finding alive any of the 19 men still piissing in the Mathilde mine faded after drillers broke through to an air pocket 262 feet beneath the Lengede village cemetery, lowered a microphone and heard nothing. Heard Tapping Noises Tapping noises had been detected earlier, raising hopes of finding five men alive in the pocket. Some of the 11 men still underground had seen five fellow workers heading for the pocket in neck-deep water shortly after the flooding started. Two more exploratory shafts were being drilled in the same area on the slim chance that some survivors could be found in other air pockets. A new six-inch wide supply shaft also was being drilled to the chamber containing the 11 men in order to lower heavier girders, wooden timbers and other construction material to help them prevent a cave-ih of the soft clay of the chamber during the rescue, operation. To Explain Tax Laws At Meeting Friday Otto F. Schug, supervisor of the fiduciary section of the Indiana department of revenue, will explain new tax legislation to members of the Adams county bar association at a meeting in the circuit court room here at 2 p.m. Friday. Members of the Jay and Wells county bar associations will also attend. Schug will distribute the new adjusted gross income tax fiduciary reutrn, form IT4I, and explain the new tax laws involved in estates, trusts and guardianships. Two Brothers Held For Cattle Rustling INDIANAPOLIS (UPD - FBI agents Monday arrested two Fort Wayne brothers on charges of cattle rustling. Authorities said Thomas Robb, 19. and his brother Richard. 24, allegedly stole 18 head of Hereford cattle from the Chicago JJnion Stockyards Sunday. They were arrested trying to sell them hero, agents said. The' cattle were valued at $5,800.
.Mew Legislation Is Endorsed By FHA

HUTNYAN United Press International* WASHINGTON (UPD — The Federal Housing Administration (FHA) has endorsed legislation intended to give it some responsibility for patching up FHA-insured homes which develop serious structural defects. However, this authority would be a last-resort device that would be used only in connection with—what some FHA of- . ficials informally refer to as—the “horror” case. This is the instance where something in the house collapses to the point where it is practically unlivable. Introduction of the bill has stirred up some old misunderstandings that have caused confusion almost since the day the FHA was born. One of these involves the significance of the imprint “FHA insured” on a builder’s sign. Just what is buyer getting? Actually, the FHA does not insure a house. It insures only the mortgage. However, by setting minimum construction standards to qualify for the mortgage insurance, the agency does have something to say about the kind of house that is built. And it accepts additional responsibility by sending its inspectors around periodically to make certain its standards are being met. Refuses New Projects The FHA already has a very effective technique for weeding out the builder who fails to respond to legitimate customer complaints. It simply refuses to approve a new project for FHA insurance until he remedies all of the defects in his present project. The blank spot in FHA coverage seems to be those few cases where a builder just refuses to take any action at all. Either he drops the FHA completely or just goes out of business. The FHA feels that since its inspectors approved the house in such a situation, it does have some responsibility for making sure that the customer does not get cheated. Administrator Robert C. Weaver of the Housing and Home Finance Agency already has testified in favor of legislation that would extend the FHA’s liability along these lines. The bill is still pending in Congress. It will have to be passed and signed by the President before the homeowner gets this additional protection. Stresses Two Points Weaver stressed two things „ in connection with this new ob- 4 ligation. First, the kind of cases it would cover involve only a very small portion of FHA business. He said builders generally were reliable businessmen interested in maintaining a good reputation in the community. The second point is that this new FHA obligational authority

would be used only where the defect is of a near catastrophic type. It is not intended to redress the grievance of the man with the leaky faucet or the stuck door. The contractor usually will handle such complaints anyway. Letters written to the FHA strongly suggest there is more confusion on this issue than just about any other in the housing field. Too many homeowners just aren’t aware of what they, are—getting. when they receive an FHA insurance commitment on their house. The biggest problem involves construction grievances. As a result, the FHA gets inundated with letters of com-, plaint from persons who should be settling their problems with the builder. The other extreme is that some homeowners, who are unaware of their rights, s are not getting the quality for which they paid. Terrorists Blow Up Venezuelan Pipeline MARACAIBO, Venezuela (UPD — Pro-Communist terrorists blew up a vital Ameri-can-owned oil pipeline for the eighth time in 18 months Monday, setting off a major oil fire. The Armed Forces of National Liberation, strong supporters of Cuban Premier Fidel Castro, were suspected of dynamiting the pipeline in the barren area about 100 miles east of here. Hundreds of fire fighters of the Creole Petroleum Corp., a subsidiary of Standard Oil of New Jersey, brought the fire under control Monday night. „ Repairs were begun today on the line which carries 300,000 barrels of oil a day from the Ule pumping station near the rich Lake Maracaibo oilfields to the Amuay refinery. An adjacent pipeline with a capacity of 225,000 barrels a day was not hit and refinery operations at Amuay continued unimpaired due to the large quantity of oil stored there. The pipelines are particularly vulnerable to sabotage because they traverse miles of sagebrush country and are paralleled by a well-traveled highway. Close surveillance of the entire 138-mile length of pipe is nearly impossible. Monday’s blast occurred* little ■more than a mile from the site of a similar dynamiting in August.
