Gov. Rollings Says State To Bow To Order COLUMBIA, S.C.MUPI) —Gov. Ernest F. Bollings told the legislature Wednesday in a farewell address which sparked a standing ovation that South Carolina must accept desegregation peacefully or be content with second-class statehood. t “We have all argued that the Supreme Court decision of May, 1954, is not the law of the land,” said Rollings, a 41-year-old attorney. “But everyone must agree that it is the fact of the land.” Bollings’ speech was in sharp contrast to Tuesday’s goodbye address to the Alabama legislature by Gov. John Patterson. Patterson urged that Alabama, which with South Carolina are the only Southern states with no school integration, offer the “fullest resistance” to desegregation and “never surrender.” Rollings said that Interposition, sovereignty, legal motions, and personal defiance all have been applied to constitutionalize the law of the land and all attempts have failed. South Carolina, he said, is running out of courts. “If and when every legal remedy has been exhausted, this General Assembly must make clear South Carolina’s choice—a government of laws rather than a government of men,” said Bollings, who will be succeeded by former undersecretary of state and exUniversity of South Carolina President Donald S. Russell. Even as Rollings spoke, the U. l S. 4th Circuit Court of Appeals in Alexandria, Va., was hearing arguments on a suit by Rarvey Gantt, a Negro, to enter Clemson College later this month. Drops Indictment Against Jasper Man INDIANAPOLIS (UPD—Federal Judge Cale J. Holder Wednesday dismissed a third indictment against William J. Rohleder, Jasper real estate man, in what may have been the final round of a 13month legal battle with the U.S. Attorney’s office and the Veterans Administration. Rohleder was charged with fraud in each indictment. The second indictment was returned because a judge quashed the first, and the third was returned because a judge quashed the second. Holder said this was “vexatious harassment to the defendant’s detriment.” Holder took into account that Rohleder was arrested three times, had posted bond and hired attorneys on each occasion and had been subjected to considerable publicity during the 13-month period He said, the third indictment, alleging the use of false .. statements during negotiations for a V.A. home loan, ‘doesn’t contain facts sufficient tc constitute an offense against the I cited States.” U.S. Attorney Richard P. Stein said the government would .no longer pursue the case. France And Monaco Near To Agreement PARIS (UPD — Negotiators for France and Monaco sought final agreement today on a pact to end the nine-month dispute between the postage-stamp principality and its powerful neighbor. Reliable sources said agreement had already been reached on the key question of taxes for Monaco citizens and industry. They said native Monegasques and long-time l residents would he allowed to keep the tax-free -status which has enhanced the allure of the tiny Riviera state ruled by Prince Rainier and Princess Grace. Foreign industrialists, particularly Frenchmen who located in Monaco to dodge French taxes, will have to pay up. The sources said the agreement worked exit in principle calls for a French tax on Monaco industry starting at 25 per cent and later raised to 35 and then 40 per cent. This still would be slightly less than similar taxes in France, t,. A five-man Monaco negotiating team beaded by Pierre Blanphi was scheduled to resume talks with Frehch negotiators at tjie Foreign Office today. State Senate Workers Are Given Warning By EUGENE J. CADOU United Press International INDIANAPOLIS (UPD — The office of hangover inspector has not yet been authorized in the biennial budget of Indiana. But employes of the state Senate, which convened today, have been warned in a mimeographed sheet entitled “Operational Rules” that sufferers from hangovers face the dire prospect of instant dismissal. Rule No. 1 says: “There will be no drinking on the job. Anyone found guilty is automatically dismissed. Hangovers will be handled in the same manner—to be paid off as of date.” This and other ominous warnings were written by Sen. John R. Rees, Columbus Republican who is chairman of the Senate patronage committee. Automatic dismissal also will be the fate of any Senate worker convicted of “lobbying for or against any bill,” according to the rules of Rees. A delicate legal question might be involved in connection with the anti-hangover ukase, which applies to secretaries, clerks, stenographers and typists employed by the upper house of the legislature. Gathering Evidence How can a hangover's existence be proved? A general lassitude usually is involved, but that could be due to a lack of sleep, a cold or a dozen other causes. There could be proof of drinking on the job by smelling the breath or forcing a drunkometer test. Hangovers are not prima facie and might be contested forcefully by any smart attorney in any court if a dismissal were appealed in a law suit. In past years, a number of the prettier female help have enjoyed long lunch hours during which the girls sometimes consumed a few martinis or other libations, according to several lawmakers. At night also, there has been quite a bit of sallying forth with legislators, lobbyists and others dealing with the,, men who makej our laws. Four Persons Killed In Indiana Traffic By United Press International Two persons, including a labor union leader, were killed in Gary Wednesday night and two other deaths hiked Indiana's 1963 traffic fatality toll to at least 26, compared with 12 a year ago. Peter Parker, 46, Gary, business agent of Local 395 of the Iron Workers Union in Hammond, died late Wednesday night, about four hours after a two-car wreck on ‘ U.S. 12 in Gary which killed Marcelino Diaz, 41‘, also of Gary, Police said Parker’s car was in ' the wrong lane and was hit by one operated by Cerbuble Concepcion, 31, who was hospitalized in serious condition.
