Komisarow. who had been using every legal maneuver possible to shake the state's, case which charged the defendant i with assault and battery on the, child to gratify sexual desires Komisarow first moved that Koenig disqualify himself from the case because the judge was sup-; posed to be a distant cousin of the [ grandmother of the mother of the 'hild When that failed, the defense resorted to objections, long and dissertations on legal opinions and even read to the court and deputy prosecutor Robert Parrish, the oath of office taken by each of the prose'eutor's staff.
The child was placed on the; stand to see if - she could tell something of what happened on Sept. 30 when the attack was alleged to have taken place. Judge. Koenig ruled that the child's state-; ments could not be accepted be-1 cause of her age but not before Komisarow had objected to Santa Claus as irrelevant and immater-[ ial. In trying to put the child at, ease. Parish asked her if Santa i Claus had been good to her. That's I when the objection came. At the end of the trial. Komisarow insisted that his client be admitted to bond after the judge had ruled that Wolfcale be taken to jail. Komisarow continued to demand the release of his client saying that an appeal was going to be made Finally, raising his voice to almost a shout, the judge said, "Mr Komisarow, will you please abide by the ruling of this court. The defendant is committed to the custody of the sheriff and that is the way it is going to be.” Koenig then consulted with probation officer Bill Hammond as to a pre-sentence investigation as required by law, and set 11 a.m. Monday for sentencing.
