Remy Bierly, of the state’s second highest court, the appellate court, which sits in Indianapolis in ' the state house, has been named presiding judge for the spring term, which lasts six months. Judge Bierly is just now completing his first year on the bench in Indianapolis. He has been quite active, •working hard to complete the large backlog of cases assigned to him for research and study. In fact, he has been able to complete quite an unusual number of cases this first year. Not a single case has been appealed from one of his decisions, nor has a case been venued from him to another judge. He has done a fine job, unniversally approved and fair and just. This is all that can be asked of a judge, and is a fine tribute to his honesty, integrity, and capability. Judge Bierly’s assignment means that he will be quite busy through the entire summer. The appellate court sits without vacation. It handles a large number of cases, and- the backlog is tremendous. It is interesting to note that Judge Bierly is the second attorney to serve as appellate court judge from Adams county—Judge Huber DeVoss having served there about 20 years ago. Judge Bierly was admitted to practice in Adams county while Judge DeVoss was circuit court judge here in the 1930’5. While Judge and Mrs. Bierly are now spending most of their time in Indianapolis, and are quite active in civic affairs and Democratic circles there, they are maintaining their .many ties here. Judge Bierly has been quite active in the Adams county historical society, Decatur Lions club, in his church, on the Anthony Wayne Parkway Commission, and the local Democratic party.

(UPD—Delaware County clerk Ralph E. Milhollin pleaded guilty Thursday to a charge that he performed an illegal marriage. Milhollin was fined sls and costs and ordered to give back the $lO marrying fee he collected from the couple. Milhollin contended he did not know of a state law forbidding county clerks from performing marriages. He changed his plea to guilty on the day his trial was scheduled to open. It was exactly 143 years ago to- ’ day that President James Madi- ' son signed document proclaim- ; Ing Indiana’s admission as the 19th state in the union. 1 Great changes have taken place 1 in Hoosierland since that historic 1 date. > The population has climbed ■ from 63,897 in 1815 to more than s four million today. The original 13 counties have increased to the present 92. Modern highways and a vast network of railroads crisscross the state where once travelers had to depend on Indiai. trails. Manufacturing and industry ■ have surpassed agriculture in i economic importance. i Hundreds of thriving cities and . towns have grown up where dense forests formerly grew. . Serious efforts to achieve state- ( hood were started by some sett tiers as early as 1811 when they grew dissatisfied with the terri- , torial governor appointed by ’ Washington and expressed a de- ; sire for self government. After many setbacks, Congress 1 in 1815 authorized citizens in the Indiana Territory to take the preliminary steps which would lead . to statehood. An election was ordered for : Aug. 5, 1816, to elect state officials i and representatives to Congress. 1 Jonathan Jennings, 32, Charles- ' town, defeated Thomas Posey by a vote of 5,211 to 3,934 and became Indiana’s chief executive at a then imposing annual salary of • SI,OOOFour months later, on Dec. 11, 1816, Madison scratched his name to the proclamation and Indiana was a state. About two-thirds of Indiana at that time was in possession of the Wea, Potawatamie. Delaware and Miami Indian tribes and most of the white settlers lived in the southern third of the stte. Land $2 An Acre A writer traveling through Indiana at that time said: “There was not a foot of turnpike road in the state, and plank roads had never been heard of; the girdled trees covered the cultivated fields, the shovel plow the only cultivator, no roads west of Whitewater, not a bridge in the state; the traveling all done on horseback. “Indiana is a vast forest larger than England, just penetrated in places by backwoods settlers, who are half hunters, half farmers.” Land sold for $2 an acre under the Land Act of 1800 and thousands of settlers were pouring into the new state from the East. More than 42,000 arrived in 1816 and the state’s population climbed to 147,178 by 1820. One of the new immigrants to Spencer County in the year of statehood was Thomas Lincoln. He brought with him his family, including a son named Abraham. The 13 original counties when Indiana joined the union were Wayne, Franklin, Dearborn, Switzerland, Jefferson, Clark, Harrison, Washington, Knox, Gibson Posey Perry, and Warrick. When the name “Indianapolis” was suggested, the room rocked with laughter. But the name was eventually adopted and Indianapolis later became the second largest state capital in the United States.
