Single copies, 0 cents. r t> Familiar Face Gone Perhaps the best-known retired businessman in Decatur the last few years was Barney Wertzberger, the 80-year-old gentleman who passed away Thursday evening after a 6-weeks illness. In the morning, afternoon, or early evening he liked to walk along the streets of his familiar “home town,” speaking to his many friends and acquaintances. His interest in Decatur was firm until the very last. While a patient at the hospital, he inqured about the recount of votes for mayor, and opined that the action by the Democratic city precinct committeemen was necessary. Know to the older generation as a barber, and to the younger citizens as owner of a confectionery, he was liked and admired by his friends. Two sons, Bud and Dick, are carrying on the family Confectionery which they have operated for several years.

COURT NEWS Petition to Vacate Street The court ruled that the street in question in Geneva is not a public utility and the request that it be vacated is denied the plaintiffs, William S. Hale and Florence Hale. Court costs were also assessed against the plaintiffs in their action against the town of Geneva. Estate Case The executrix of the Bessie L. Greene estate is ordered to make distribution in terms with the final report, which was also filed. The proof of publication was similarly filed. Estate Cases A petition to reopen the Frediß. Tonnellier estate, by Mary A. Tonnellier, administratrix, was granted to allow her to cash a SSO U.S. government bond found since the estate was closed. A schedule to determine the inheritance tax of the Emil Christener estate was filed, showing that 35 acres were sold at private sale for $16,000; and that the checking and savings accounts, Farm Bureau stock, and U. S. bonds amounted to $8,003.15; that personal property and farm property was valued at $2,243.47; and that debts were $4,829 10, leaving a net estate of $21,417.52, with heirs share, for tax purposes, amounting to: brothers, Charles Christener of Monroe, $7,139.17 and Fred Christener of Monroe, the same; nephews John Christener, Jr., of Monroe and Roger Christener of route 4. Decatur, $1,784.79 each; nieces Bonnie Lou Burger of route 5, Decatur, and'Miss Marie Christener of Monrde, $1,784.80 each. Each took a SSOO exemption. In the estate of Henry A. Aschleman, the executrix, Daisy M. Aschleman filed a final account and petition to distribute the estate, which was nil, the executrix paying $1,087.66 from her own funds towards estate costs. In the Rose M. Kleinhenz estate, the net value of the estate was set at $2,954.87,. with $122.74 taxes due, and $9.82 due to the county; Arthur B. Kleinhenz, brother, was assigned the entire estate for tax purposes. Divorce Granted George Kahn was granted an absolute divorce from his wife, Myrtle, Wednesday when she failed to appear. He was granted two trucks, and she was awarded the real estate, a lot in the Homewood addition. She wai also adjudged to pay the costs. Extraordinary Appearance Edwin K. Steers, attorney-gen-eral of Indiana, made an extraordinary appearance in the case of Gualalupe Garze vs Severin Schurger, prosecuting attorney, Merle Affolder, sheriff, and Raymond C. Gilbert, commissioner of motor vehicles, state of Indiana, a petition for a restricted driver’s license, and asked that the petition be dismissed on the grounds that the plaintiff did not serve the attorney general or his appointee in the motor vehicle department with a copy of the complaint, as required by statute, found in Bums 49-1937. Foreclose Mortgage The Adams County Farm Bureau Cooperative association credit union of Adams county filed a complaint to foreclose a chattel mortgage against William H. and Frieda Stavenik, to collect $319.50 plus $l5O lawyer’s fee, due on a promissory note filed Oct. 9, 1956 with a mortgage against beauty shop equipment, for $2,827.40. Voglewede, 603 W. Madison St., Decatur, recently qualified as expert in firing the M-l rifle while serving with the 9th chemical depot company in Germany. Voglewede, a maintenance specialist In the company in Mannheim, entered the Army in June, 1958, and received basic training at Fort Knox, Ky. He arrived overseas in November, 1958. Voglewede is a 1955 graduate of Decatur Catholic high school and attended St. Joseph's College, Collegeville.
