(Editor’s note: This is another in a series of articles presented as a public service by the Adams county bar asociation. These articles are not Intended to answer individual problems which require specific advice.) NEGOTIABLE INSTRUMENTS Suppose that Mrs. Housewife wants to buy a sweeper. She may not have the SIOO or so required to pay for the appliance. The salesman will probably ask her to sign a negotiable promissory note, perhaps payable in 30 days. When Mrs. Housewife signs the note, the salesman will give her a sweeper. The sweeper company in turn will probably sell the note to a bank or commercial credit company. Thus, Mrs. Housewife has the sweeper,’ the sweeper company has funds with which to do business, and the bank holds the promise of Mrs. Housewife to pay a sum of money. The bank, of course, will pay to the sweeper company something less than the face value of the note. The difference is the gross profit that the bank will earn on the transaction. If the sweeper turns out to be defective, and contrary to the representation made by the salesman, an interesting problem arises. Mrs. Housewife may feel that she is not legally obligated to pay the note, until some adjustment is made with regard to the sweeper. However, the law of negotiable instruments requires that Mrs. Housewife must pay the face value of the note plus any interest to the bank in spite of the defect in the merchandise. At least such results follow if the bank has taken the note under these circumstances. • Mrs. Housewife certainly has the right to a sweeper in the condition represented, or damages resulting from the defect. But Mrs. Housewife must pursue these remedies against the sweeper company or its salesman. The fact that the merchandise is defective does not give her a defense against the bank on the note. Whenever Mrs. Housewife signs a promissory note or other negotiable instrument she should be sure to pay the person who produces the note and demands the money. For example, if Mrs. Housewife had paid the sweeper company at the end of the 30-day period, the bank, as holder of the note, could none the less collect from her. Checks, drafts, promissory notes, and bills of exchange, are types of negotiable instruments. They are, in effect, unconditional promises to pay a definite sum of money to the bearer or indorsee of the in-

Others denounce me for making “Charles Van Doren the whipping boy” (I didn’t intend to—honest). “...Thanks to you for your ‘battle of deception versus truth’, wrote Mrs. Helena B. Collins, Santa Rosa, Calif. “Stand firm!” Edward W. Verba. Campbell, Ohio., wrote that “if the transition were made to boxing, any boxer who participates in a fixed fight is held in contempt by the majority of boxing fans.-. “I agree with your article..on the scandal.” Miss Addie L.
