' 232 6t Ligonier Officials Chide Stale Court INDIANAPOLIS (UPI) — Ligonier officials Monday contended they had a right to fire their police chief and chided the Indiana Appellate Court for its “failure to differentiate between those who work by brain alone and those who work by brain plus brawn.” Former police chief Elmer Bole was fired by incoming Mayor Roy J. Jorg’s Board of Public Works and Safety in January, 1956. Bole, who was 71 at the time, was dismissed shortly after the board adopted a resolution setting the maximum age for the police force at 70. The board refused to reconsider its action after Bole appeared before it to show that he had never missed a day’s work and had done a good job. Bole appealed to Noble Circuit Court which upheld the board. Bole appealed to the Appellate Court. In a unanimous decision handed down last Tuesday, the state’s second highest court sided with Bole. It criticized both the board and Noble Circuit Court for an action which was “wholly arbitrary, capricious and contrary to law” and ordered the city to reconsider the case. Monday, the city asked the Appellate Court to reconsider its ruling. In addition to the brain versus brain plus brawn argument, the city said the court “failed to consider the public policy of the State of Indiana as . declared and established by the General Assembly.” ; Fort Wayne Driver Is Killed By Train United Press International A Fort Wayne motorist was killed by a train near Anderson today, raising Indiana’s 1959 traffic death toll to nearly 800. The death of John Phillip Smith, 25, when his car was hit by a New York Central freight train on a county road crossing five miles east of Anderson during a rainstorm unofficially was the 798th death of the year in Hoosierland. Nevertheless, the state’s traffic safety record the last nine days has been excellent by any standard of measurement. Hie toll last week was held to 13, including a couple of deaths recorded after the weekend from injuries sustained during the week. Only four weekend fatalities were recorded, far below normal for this time of year. One fatality was reported Monday when Ernest Bostrom, 50, Dixon, 111., was killed in a traincar crash at a Chicago & Eastern Illinois crossing near Vincennes.

Estimate Two Million Dollar Flood Damage United Press International Officials in the Southwest totaled up the damage today from nearly a week of rain and sought to prevent further flooding in Oklahoma and Texas. At the same time, a massive drive was underway in Colorado to rescue thousands of head of cattle and sheep still marooned by last week’s five-day snow storm. Civil defense officials in Tulsa, Okla., said flood conditions there were still critical and nearly a thousand volunteers sweated to build a sandbag wall along the Arkansas River. The Texas disaster and relief division estimated damage from a weekend of floods and tornadoes and a conservative two million dollars. The flood threat in the DallasFort Worth area eased when the Trinity River crested at 35 feet. Farm and ranch lands downstream were expected to be flooded today, however. Farm lands around Mineola, in east Texas, also faced flooding from the Sabine River which was expected to crest at 17 feet today, 3 feet above flood stage. A drying-out period was in prospect for the Southwest, the U.S. Weather Bureau said, but a lowpressure zone dumped up to an inch of rain on parts of the eastern half of the country. Severe thunderstorms and a tornado forecast were issued for portions of Illinois, Indiana and Michigan today. Motorist Is Cited Following Accident City police cited William Scott Haley, 41, of 244 N. Seventh street, on three counts following an accident Monday afternoon at Second and Marshall streets. The llaley machine struck a car driven by Sydney R. Stucky, 16, of 'Berne, as it was stopped at a stop sign on Marshall street. The Haley car had been going north on Second when it turned right onto Marshall, striking the Stucky car. Damage to the Haley machine was light, but the Stucky machine sustained S2OO in damages. Haley received a citation for leaving the scene of an accident, no operator's license, and reckless driving. He will appear in mayor’s court next week. Reckless Driver Scored By Judge BLUFFTON, Ind. (UPD — Earl Edwin Elrod, 31, Indianapolis, spent eight hours in Wells County Jail Monday and lost his driving privileges for six months for operating his car recklessly in the Bluffton business district one night last summer. Judge Homer J. Byrd said that despite Elrod’s appeal for leniency because his wife had undergone eye surgery and one of their five children was hospitalized as the result of a fall, he saw no reason for light treatment. “A person driving as you did is a potential killer,” Byrd told Elrod. “We must remove this type of person fromthe roads.” Over 2,500 Dany Democrats are sold and delivere' in Decatur each. day.

(UPD — Police hoped a report expected from the state crime laboratory today would help them identify a young girl whose dismembered body was found in this Milwaukee suburb. Police Chiel Robert Milke said he believed the girl was murdered, possibly by a maniac butcher. The girl’s head was discovered Sunday night by a woman picking wild flowers. Searchers Monday found other parts of the girl’s body. Authorities hoped the crime lab report might tell them how the girl, estimated to be about 7 years 1 old. met her death. Found with the remains were , “several buttons" and some cloth- ■ ing, "either pajamas or under- : wear,” according to Police Sgt. : Charles Engel. r Police, meanwhile, were going > through missing files in Milwau- ; kee and Chicago to try and learn > the girl’s identity. t Gordon C. Ritchie,. Milwaukee whose daughter and wife have been missing since May 13, looked at the remains Monday but was unable to make any identification. Ritchie said his wife, Myrtle, 41, had been released from a mental institution shortly before she disappeared with his daughter. Nancy Marie, 6. He told police his girl had several teeth missing and her blond hair was cut short. The head found Sunday had four upper and four lower teeth missing. It had fine blond hair, cut short, authorities said. Engel, who found the rest of the body Monday, said all parts except the head were found in one area, indicating the body had been placed there and decayed on the spot. Also found was a cardboard box which contained what police said appeared to be human bones, pieces of skin and a pair of man’s gray work gloves. There was also a part of a copy of a May 20, 1959, issue of the Milwaukee Sentinel and a burlap sack in the box, located next to a woodpile in the search area.
