Driver Is Forced To Stop Truck, Beaten COLUMBUS, Ind. (UPD—Harold R. Cromley, 31, Bainbridge, told police four men in two cars forced him to stop his truck in a narrow bridge on U.S. 31 and beat him in an incident he blamed on labor troubles. Cromley said one of the men told him to “quit driving or I’d get worse.” Cromley said he drives

Opposes Appeal Os Wife Swap Slayer INDIANAPOLIS (UPD — Indiana Atty. Gen. Edwin K. Steers late Tuesday filed with the clerk of the Indiana Supreme Court a brief in opposition to Thomas Whitaker’s appeal of his "wife swap" murder conviction. Whitaker, Terre Haute, now confined to death row in the Indiana State Prison at Michigan City, was sentenced to die in the electric chair by a Vigo Circuit Court jury for the shooting death of his daughter. Whitaker’s former wife and his son also were killed in a wild shooting spree at Terre Haute in 1957 as the climax to a strange "wife swap” ar - rangement between Whitaker and Stewart Martin, a long - time friend. The Supreme Court on July 9 delayed Whitaker’s execution date to Nov. 30 to allow him additional time to prepare his appeal. In his brief, Steers said Whitaker bases his appeal partly on the claim that the judge erred in allowing the jury to leave the courtroom and return to their homes for the evening during the early stages of the trial. But Steers said the judge was within his legal rights to do so because a decision of that nature was entirely the "discretion of the court.” “There appears to be a growing trend evidenced by decisions from other jurisdictions toward a relaxation of the common law rule which did not permit of separation and gave little heed to the comfort of the individual jurors,” Steers said in his answering brief.

(UPD— Indiana University Tuesday received a $543,700 grant from the U.S. Public Health Service to pay for half the construction cost of. a new health research building to be used by the university’s psychology department. I. U. will match the funds. Khrushchev To Speak To United Nations UNITED NATIONS (UPD—Soviet Premier Nikita S. Khrushchev will address the United Nations General Assembly when he comes to the United States next month but the date and time have not yet been worked out, it was reported today. U.N. sources said Secretary-Gen-eral Dag Hammarskjold invited the Soviet leader to make a speech and Khrushchev accepted. Littler Withdraws At Motor City Open DETROIT (UPD — Gene Littler of Singing Hills, Calif., one of the biggest money winners on the PGA circuit this year has withdrawn from the Motor City Open Golf tournament which begins Thursday. Littler explained that a hay fever attack prevented him from taking part in the tourney. Sox Lose Aparicio For Several Days DETROIT (UPD — Shortstop Luis Aparicio will be out of Chicago White Sox lineup for several days because of a pulled muscle in his left leg. Aparicio injured his leg at Washington Sunday and aggravated it further during infield practice at Detroit Tuesday night.
