Individual Musi Sign Instrument (Editor’s note: The following article is presented by the Adams county bar association and the Decatur Daily Democrat as a public service and concerns the enactment of a new law by the Indiana legislature which took effect July 1.) Chapter 110. House Bill 43 provides that no instrument by which title to real estate or personal property, or any interest therein or lien thereon is conveyed, created, encumbered, assigned or otherwise disposed of; shall be received for record or filing by the county recorder unless the name of the person who, and the governmental agency, if any, which prepared such instrument appears at the conclusion instrument and such name iseither printed, typewritten, stamped or signed in a legible manner. An instrument will be in compliance with this section if it contains a statement in the following form. "This instrument was prepared by (name).’’ The act does not apply to any instrument executed prior to the effective date of the act nor to the following: any decree, order, judgmen or writ of any court; and any will or death certificate; any instrument executed or acknowledged outside of this state. It should be pointed out that the enactment of this law constitues a change in recording procedures which is new to the entire history of the State of Indiana. It has been brought on by the fact that in our present day living, we have arrived at a complex way of life; that new rules, regulations, taxes and laws have placed extreme importance on the method which we use to convey and transfer property. Extreme care must be exercised in the drafting of any deed , or document which transfers title to property or disasterous results may be in the offing for the seller or buyer. The lawyers of this County have seen, time and time again, titles to real estate become entangled in quiet title suits and litigation due to drafting of deeds by inexperienced laymen. Undue fax burdens have been cast upon parties to instruments by faulty or ambiguous agreements. The above new law is designed to disclose the name of the person

or persons drafting documents of this type. In the event a persons undertakes to draft a legal instrument as provided in this law, such person is engaging himself in the practice of law and unless he is a lawyer, his practice is unauthorized and illegal. The most recent decision as reported in the Unauthorized Practice News of the American Bar Association was handed, down by a State Supreme Court April 27, 1959 which in part reads as follows: "With reference to preparing deeds, notes, mortgages, and contracts in real estate transactions, respondent seems to consider those act as being more or less mechanical and routine, requiring no legal knowledge or skill. A transaction which at first seems simple may upon investigation be found to be quite involved. One who merely fills in certain blanks when other pertinent information should be elicited and considered is rendering little service, but is acting in a manner calculated to produce trouble. When filling in blanks as directed, he may not by that simple act be practicing law, but if h eelicits the proper information and considers it, and advises and acts thereon, he would in all probability be practicing law. In other words, if his service does not amount to the practice of law, it
Is without material value; bui if it is of material value, it would likely amount to the practice of law. The public should be protected from falling into the hands of one not skilled in the laws of conveyancing when seeking advice or service having to do with real estate titles.” It is the opinion of the County Bar Association that this new law emphasizes the need to have your legal documents drawn by your attorney, prescribed to fit your particular legal problem as you would expect your physician to prescribe his treatment to fit your particular health problem.
