Fail To Decide On New Preble Trial INDIANAPOLIS (UPI) — The Indiana Supreme Court, sitting in a special session, late Tuesday failed to decide whether to grant a new delay in the highway scandals case involving Austin housemover Marvin Preble. Preble was sentenced to 1-10 years in prison in connection with filing a claim for payment for moving a house. Evidence later showed he failed to move the house. He already obtained four appeaf delays. The special session was called by Chief Justice Harold Achor. But when it was over, he admitted that the five judges were no closer to a decision then when the closed meeting began. Achor said the court would

neither grant nor deny Preble's petition for another 80-day delay "pending further information/’ No decision can be reached until the court determines the facts regarding the filing of the petition by John W. Agnew, Preble’s attorney, last Thursday. Agnew told the court hie needed the delay because the transcript clerk in the Marion County Clerk’s office had not completed the record of the case. But Agnew’s version was refuted by Mrs. Jewel Gobol, a Marion Superior Court reporter who said she handed Agnew the 500-page transcript in March, 1958. Achor said the high court would seek the aid of Indiana Atty. Gen. Edwin K. Steers in dit wiring the "true facts.” Achor did not say how long that would take. McClenahan Named As Judge Pro Tern Hubert R. McClenahan has been appointed judge pro tem of the Adams county circuit court. McClenahan will take the place of Judge Myles F. Mounting Toll Os Lives From Severe Storms United Press International The Atlantic Seaboard broiled today in a persistent, early-sum-tner heat wave, and violent thunderstorms hit wide sections of the Midwest and Southeast. The durable heat wave and damaging storms took a mounting toll of lives. At least eight deaths had been attributed to the weather since the hot weaher gripped the eastern half of the nation last week end. A construction worker died of "sunstroke” Tuesday on a job at . Irwin, Pa., and a 10-year-old Lit- < tie League baseball player was ! killed by a lightning bolt in an Indianapolis, Ind., sandlot. Six other deaths were blamed on the weather —two in New York City, and one each in North Carolina, New Jersey, South Carolina and Tennessee. The Weather Bureau in Chicago said a dawdling cold air mass would drift slightly southeastward today and bring some cooling in a band stretching from eastern Oklahoma to central Illinois. Forecasters said, hot, humid weather could continue in the South and most of the Eastern Seaboard. Temperatures in the heat belt Tuesday soared to 104 at Louisburg, N.C., 1(B at Columbia, S.C., and Richmond, Va., 102 at Raleigh, N.C., 101 at Danville, Va. and Montgomery Aja., 100 at Washington, D.C., and 94 as far north as Boston.
