Prosecution Not To Make Death Demand INDIANAPOLIS (UPD — The prosecution will not demand the death penalty for Mrs. Connie Nicholas in opening statements at her murder trial. But chief trial deputy Francis Thomason, who will deliver the state’s opening summary at the trial of tire 44-year-old career woman for the slaying of Forrest Teel, 54, said that does not rule out the possibility the demand will be made later in the trial Twelve husbands were sworn in Wednesday as the jury to hear the evidence. The state obtained from each a statement that he does not object to execution of a woman convicted of first degree murder. The state hopes to prove that Mrs. Nicholas deliberately plotted the death of Teel, her partner in extra-marital romance for 15 years, when she discovered ‘he was abandoning her fora younger woman. Teel, a handsome wealthy executive of an international drug firm, was killed as he sat with Mrs. Nicholas in his white Cadillac outside the apartment of Miss Laura Mowrer, 29-year-old secretary for the same drug firm. Good Friday Recess The slaying occurred July 31 and ohe of the delaying factors in the trial was the recovery of the defendant from Injuries which have left both hands crippled and one arm paralyzed. Tie trial was in recess because of Good Friday today and will be until Monday. But Judge Thomas Faulconer will be busy studying proposed instructions to the jury and conferring again Saturday with defense and prosecution attorneys. The defense asked that the jury be told Mrs. Nicholas could be found guilty of the lesser crimes of assault and battery with intent to kill, assault and battery, or simple assault, in addition to the crimes of first or second degree murder or manslaughter. Conviction upon assault does not necessarily require a prison sentence. Hie state said it will take exception to any judicial instructions raising the possibility of any finding other than first or second degree murder or manslaughter. These were the crimes mentioned, in the judge’s tentative instructions and the prosecution did not offer any additions. Thomason said the state’s medical experts will testify that the impairment of the defendant’s arm and hands was" not due to any injury inflicted by Teel. Two Hoosiers Killed In Airplane Crash ILLIOPOLIS, IU. (UPD — Two Indiana men were killed in the flaming crash of their two-passen-ger airplane Thursday in a farm field. The dead were identified as W, W. McWhorter, 46. Flossmoor, 111., an engineer for the Grayer Tank Co., East Chicago, Ind., and John B. Toren, Hammond,. Ind. Authorities said they were unable to determine Who was piloting the crait. Both bodies were badly mangled and the plane was destroyed, authorities said. The plane burst into flames moments after it plunged through a fence and crashed. Mrs. Sam Swanson, a Macon County farm wife, said she heard the plane’s engine sputter. Moments later the plane crashed In a field on her farm about a half mile from her home. Walter Tucker, a farmer, said; he heard the plane circling low., ■.’ i like he i was going to land,’’ Tucker said. “Then the motor roared, probably when he »aw that fence.” • <0 Walla Walla, the name of a city in Washington State, means “many waters” in Indian. Khrushchev Hoping To Strengthen Stand PARIS (UPT)-Soviet Premier Nikita Khrushchev steered the Western powers to a summit conference on purely European matters to keep Communist Chinese leader Mao Tze-tung from joining the talks, informed sources said today. They said Khrushchev hoped to strengthen his position in the Communist world as regards Red China by scoring a propaganda victory by meeting with the Western chiefs of state. > Western diplomats believe the move may increase chances for success at the summit conference, now tentatively scheduled for sometime this summer, the sources said . At any rate, they sgid, the West feels, Khrushchev should be allowed to state his case for peace in Europe and, in a wider context,.far the rest of the world. Khrushchev, who had been plugging foe a summit conference on the Middle East last fall, suddenly reversed his field after meeting with Mao in Peiping last July 31. The sources here said Khrushchev called off the talks with the West because Mao had insisted
