Denies Government Motion To Dismiss Judge Scores Move By U.S. Attorney INDIANAPOLIS (UPD-Federal Judge William E. Steckler today denied a government motion to dismiss a perjury indictment against Boston trucking executive Daniel P. Shanahan in connection with a grand jury probe of a multi-million - dollar international gambling syndicate. Shanahan was scheduled to be tried Nov. 24 on a charge of lying to a federal jury which later returned gambling indictments against eight men in a raid on a Terre Haute betting lyaout a year ago. Steckler ordered trial to be set for the January term. Shanahan was one of nearly 200 persons, including wealthy businessmen and gamblers, who appeared before the grand jury last summer. , U.S. District Attorney .Don A. Tabbert moved Nov. 19 to dismiss the indictment against Shanahan on grounds that such action was in the best interests of justice. " X ■ ..K.t1..... -4-
THURSDAY, DECEMBER 4, 1958
Steckler called Tabbert’s action •n “Hth hour” move. He criticized Tabbert in his ruling for giving the judge “absolutely no factual basis upon which to base'” what he called “sound judicial discretion” required of the court by a U.S. Supreme Court nde. “The court concludes,” Steckler said, “that the attorney general or the U.S. attorney should be given an additional opportunity to give the court in an appropriate manner such information as they believe justifies the contusion that in the of justice the indictment should be dismissed. “Untl that is done, leave of the court to dismiss the indictment is denied.” Steckler said perjury "strikes at the very trunk nerve of our system of administering justice.” Instead of paying President John Wheelock his salary of $912 in 1814, Dartmouth College was so financially pinched that it had to borrow money from him.
