Perjury Trial is Off Court Docket State Asks Judge . Drop Indictment INDIANAPOLIS (UPD —The perjury trial of Daniel P. Shanahan, 33, Boston, was removed from the Federal Court docket for next Monday while Judge William

Steckler studies a motion to dismiss a grand jury indtetment. Shanahan, owner of a trucking firm, was indicted after, he appeared before a grand jury investigating a multi-million dollar international gambling syndicate which operated for 10 weeks at Terre Haute during the 1957 football season. U. S. District Attorney Don A. Tabbert filed a motion to dismiss Thursday, presumably because he feared that evidence in the

trial originally scheduled to begin Nov. 24 would tip his hand regarding evidence against eight alleged gamblers indicted by the same jury. Steckler did not rule immediately on Tabbert’s motion. But he removed the case from next week’s court calendar. Gambling indictments against the eight men arfe pending. No trial date has been set. All eight pleaded innocent and sought to have the indictments quashed.

Boldt will rule Monday - on a legal log jam that has tem-j porarily roadblocked the Dave Beck income tax evasion trial. Beck, former president of the ’ Teamsters’ Union, is charged with i evading $240,000 in income taxes during the years 1950-1953. Friday, check stubs were ad- , mitted as evidence of financial dealings between Beck and a Chicago labor relations expert. The exhibits were described as the “informal records’’ of Nathan Shefferman, head of labor relations assuciaites of Chicago, by Shefferman’s bookkeeper, Miss Florence Ouska. Shefferman’s contribution to Beck’s wealth is one of the key pieces on the government’s jigsaw puzzle by Which it hopes to depict that Beck evaded income j taxes during the years 1950-1953. Boldt had admitted two of the check stubs but after a confer--

The defense contends tht stubs are not admissible because they are not “business records.” The government admits they are not business records but contends they are part of the transactions involving Beck and Shefferman.
