Fired Excise Man Not To Appeal Case Fired In State Job After Conviction . INDIANAPOLIS (UPD — A former state excise officer fired by; the Indiana Alcoholic Beverage Commission after his conviction on a drunk driving charge said today he has decided not to appeal the case, Joe D. Rice, Huntington, reached at his place of employment in Huntington County, said he had considered the appeal because he felt he was unfairly convicted but “I don’t have the money for an appeal and I can’t spare the time from my new job.” • Rice said-he had decided to let the matter drop. He was convicted after a Sept. 16th trial in Fulton Circuit Court. Rice said he was employed in “family business.” The ABC announced his dismissal Monday. ABC Chairman Noble, Ellis said he felt the commission acted fairly in suspending Rice July 21 when he was nabbed by a sheriff's deputy and in dismissing him after conviction and suspension of his driver’s license. Ellis said the ABC will make no decision in the case of another suspended excise officer. Sgt. Oda Collins, until Collins is tried in court. Collins, charged with public intoxication, also was charged in Fulton County. His trial date has not been set. The two excise officers said they had taken several drinks in the course of gaining, evidence of liquor law violations. Both denied they were intoxicated. Shoulder Injured As Auto Hits Bike Joseph H. Rouseau, 12, son of Mr. and Mrs. Joseph Rouseau of 324 Marshal street, received a skinned left shoulder Monday evening when the bicycle, he was riding collided with an automobile at the alley located near Newberry’s store.
