LEGALLY SPEAKING (This article is one in a series of 30 by the Adams - county bar association presented as a public service by the Decatur Daily Democrat to inform the public of the point out various problems services of the lawyer and to yvhich might arise when com, petent legal advice is not obtained. These articles are not intended to answer individual problems which require specific advice.) , Divorce Mary Ice has just finished testifying in her divorce trial against her husband. John Ice. John is not present in the court room, although he has been notified of the trial date. The defense attorney states that there is no cross examination, and the judge informs Mary Ice that she may step down from the witness stand. The Judge then pauses, and states that although he is reluctant to grant divorces, that inasmuch as the plaintiff, Mary Ice, has proved a prima facie case for divorce and inasmuch as the defendant, John Ice, has not seen fit to either deny the plaintiff’s complaint, or to appear in court opposing it, that he has no alternative but to grant the divorce. The judge then start dictating the entry to bemade. "It is therefore now ordered, adjudged, and decreed by the court that the ' bonds of matrimony herefore existing between plaintiff and defendant are hereby dissolved. . . ” In Indiana divorces may be de--1 creed upon the application of the ; injured party for the following causes, and no other: First adultery; second, impotency, existing at the time of marriage; third, abandonment for two years; foui th. cruel and inhuman treatment; fifth habitual drunkenness on either party or failure of the husband to make reasonable provision for his family; sixth. of an infamous crime; eighth, incurable insanity, provided, however, that the insane person shall be duly and regularly committed and confined in a hospital or asylum for the insane for a period of at least five years prior to the commencement of the action. The most common ground for a divorce in Indiana is cruel and inhuman treatment. This ground covers mental as well as physical cruelty. In addition to divorce, Indiana has a so-called separation from bed and board statue, which means that the parties are legally separated, but unlike divorce, are still married during the stipulated period of separation. The grounds for separation from bed and board are quite similar to divorce. Indiana requires that before any person can file for divorce that the necessary residential requirements must be met, which requires a one-year residence in the state, and a six month residence in the county where the case is filed, which residential requirements must be immediately prior to the date of filing of the action. In other words, in the event that a resident of Indiana would state for a period of time, then move his residence to another come back to Indiana, he must start all over to regain his rest* : dence and would have to live in this state for at least one year l prior to the filing of the divorce ac--1 tion, and must also live in the • particular ’county at least six • months prior to the filing of that action in that county. These residential requirements • are jurisdictional in nature, and ; cannot be wavied. In other words, • if the other party is agreeable to allowing the per Son to file, even though the proper residential requirements have not been met, this cannot be done, as the court has no authority to hear the case unless at the time of filing of the case, the proper residential re- ■ quirements have been met. In ■ fact, at the time of filing of the . complaint, an affidavit showing . the residential requirements must .be accompanied with the com- ■ plaint.
Also, at the divorce hearing the plaintiff must prove by two resident freeholders, the necessary residential requirements. In addition to the residential restrictions, Indiana has a “cool-ing-off-period” statute.
