Appeals Court Protects The institution of appellate courts, of which the supreme court is the mghest, illustrates how America has tackled the problem of attaining justice. Plato long ago showed that the idea of justice is difficult to come by. It is perhaps even more difficult I to transalte into human conduct ; and apply in the settlement of . individual cases. Let us see how a case comes before an appellate court. We . assume that every civil action ’ that comes before a trial court i originates in an honest difference : of opinion as to what the law or . the facts of that case are. between your two lots, you would be foolish to 'go to court for a settk-'ient If you did not believe that right was on votfr side. But right cannot be on both sides; so we say that one or the other of you is mistaken. When you seek legal counsel on such a question, it frequently happens that your lawyer will advise you not to go to court. Only a relatively small percentage of cases' reach tiral. The law is clear enough so that among the millions of transactions taking place in the country only a relatively few ever result in lawsuit. But you and your lawyer have decided that your case has enough merit to warrant your going to court. The facts on both sides are presented, the lawyers on both sides argue the merits cf their clients’ cases and the court is then called upon to render a decision. The vast majority of the cases are settled then and there with the decision of the trial judge. But judges, like all of us, are human and the law is complicated and subject to interpretation. At times they, too, may err in admitting the evidence, or in interpreting the law applicable to the facts. Under such circum-
. ; 1 stances your' case may be appealed to an appellate court. Some states have Intermediate courts between the trial court and the supreme court of the state. Such is the case in Indiana where we have the appellate court and the supreme court. Trial courts in Indiana are known as circuit courts and here in Adams county we have the Adams circuit court. In Indiana a case may be appealed from the circuit court to the appellate gcourt. From there is may be appealed to the supreme court which is the highest court of appeal in the state. In some cases, due to the nature Os the question involved, an appeal may be made from the circuit court directly to the supreme court without first appealing to the intermediate appellate court. When you appeal your case, you ask that the error you believe you have found be corrected. If it was an error, that is what will happen—the trial judge’s decision will either be upheld or reversed. Sometimes the courts are compelled to decide a question one way because the law says so, but the results bring to light serious defects in the existing law.
