LEGALLY SPEAKING (This article is one in a 1 series of 30 by the Adams county bar association presented as a public service by the Decatur Daily Democrat to inform the public of the point out various problems services of the lawyer and to which might arise when competent legal advice is not obtained. These articles are not intended to answer individual problems which require specific advice.) NEGOTIABLE INSTRUMENTS In the town of Middleville, Mrs. Housewife wanted to buy an appliance. let’s say a new vacuum cleaner. The salesman had presented the merits of the machine and the cost was about SIOO. Mrs. Housewife didn’t have the SIOO required to pay for the appliance and the salesman informed her that he , would be happy to take her negotiable promissory note perhaps ’ payable in 30, 60 or 90 days in or- ■ der to accommodate her, and further informed her that he would leave the appliance With her at that time, and that it would be hers. This, in brief, is an every day transaction, but let’s see what happens next. Mrs. Housewife now has the appliance, the salesman turns in the promissory note to his company, who in turn sells the note to a bank or commercial credit company. The bank or credit ■ company, of course, will pay the company something less than the i face value of the note. Hie difference is the profit that the bank will earn on the transaction. If the appliance turns out to be defective, or contrary to the representation made by the salesman, an interesting problem for Mrs. Housewife occurs. She. may feel that she is not legally obligated to pay the note until some adjustment is made with regard to her new vacuum cleaner. The law of negotiable instruments, however, requires that Mrs. Housewife must pay the face value of the note, plus any interest to the bank, who is now the owner of the note, in spite of the defect in the merchandise. At least such results follow if the bank has taken the note under these circumstances. They must give value for the note; they must

take it before it is due or before maturity; they must take iv in good faith and without notice of defects in the note or In the title of the person who sells the note to them; the note must be complete and regular on its face. The bapk is then said to be "a holder in due course.” Now of course, Mrs. Housewife certainly has the right to an appliance in the condition represented or to get damages resulting from any defect. But Mrs. Housewife must pursue her remedy against the appliance company or its salesman, and the fact that the merchandise is defective does not give her a defense to the demand of the bank or credit company, or any subsequent holder in dug course. Another itefn is that since Mfrs. Housewife did sign the promissory note she should pay only the person who produces the note and demands the money, for example, if Mrs. Housewife would pay the sweeper company at the end of the 30, 60 or 90 day period, the bank, as holder of the note, could none the less collect from her. The law of negotiable instruments which controls a case like this does favor these persons who are not parties to the original transaction but, who like the bank or credit company, subsequently buy the instrument. This policy is sound for it permits negotiable paper to flow with the minimum obstruction through the channels of commerce. Checks, drafts, promissory • notes, bills of exchange and certificates of deposits are types of ne- : gotiable instruments. They are, in effect, unconditional promises to i pay a definite sum of money to the ■ bearer or endorsee of the instrument in a fixed or determinable time. Their use dates back to about 1600 in England. i Os the total volume dollar of commercial transactions, an estimated 90 per cent are consummated by the use of one or more of negotiable instruments. The negotiable instrument is, therefore, an important part of modern commercial transactions. — Always make sure you understand the legal responsibilities you incur when you sign such a document. and if you entertain any doubt as to its meaning, it is wise to seek competent legal advice.
Few New Shows On Summer Television Summer TV Full Os Re-runs And Sluch By WILLIAM EWALD United Press Staff Correspondent ‘ NEW YORK (UP)- What with J “Climax” running a kinescope ; Thursday night and “Playhouse - 90” turning to film, it was a lit- ' tie like sipping summer TV in advance. ' 1 CBS-TV, shackled by a technicians strike, had a strong excuse for avoiding live telecasts. But for some time, I’ve been wondering about this business of summer TV and why the networks surrender to catchpenny blahs and re-runs whenever hot weather hoves in view. Oh, actually of course. I'm just pretending. I know why- Summer TV is full of things like re-runs because it’s cheaper that way. It’s a little like adding water to milk to stretch it, maybe not very satisfying, but then how often have you as a consumer ot TV ever complained about your summer television being watered down? You don’t, so here’s what you’ll get; Repeats and More Repeats You'll get repeats of filmed shows until they run put the rabbit ears of your antenna. In fact, this business of re-runs has now reached the point where yankedoff shows now are being replaced by re-runs of other shows. Thus, when NBC-TV’s “Your Hit Parade” goes off, you’ll get the old “On Trial" series retitled “The Joseph Cotten Show.” In place of NBC-TV’s Gisele MacKenzie. starting Saturday you’ll see “Turning Point,” which is actually just old “G.E. Theatre’’ and “Schlitz Playhouse” shows and a new name. CBS-TV will take the “Danny Thomas Show” off for the summer and replace it with “I Love Lucy” re-runs. Where CBS-TV has “I Love Lucjr” now (Wednesday night) you’ll see another revived series, “Gerald Mcßoing Boing." “The Brothers” is coming back in place of Jack Benny on CBS and NBC-TV also is reviving another flop series, “Noah’s Ark” for Sundays. . Right now, the tentative summer network schedules show only a sprinkling of new shows: At NBC-TV, a roster of singers and comedians for Dinah Shore, the Steve Lawrence-Eydie Gor m e Show for Steve Allen, a filmed Western called “Jefferson Drum,” a possible anthology of discarded “Pilot" fUms, and what looks like a medium-budget variety replacement for Perry Como. ABC-TV has "ESP” as a summer replacement for Frank Sinatra a new quiz, “Anybody Can Play’’ and a clump of on-film what-is-its like “Enterprise," “Your Neighbor. "The World” and “Holiday Handbook ” Fair Possibility CBS-TV thus far has only one fairly interesting possibility—“ Too Young to Go Steady” with Don Ameche as a live replacement for "December Bride” — but there also has been some talk recently of holding it off fill fall. The schedules aren’t completely filled in yet, but there .doesn’t seem to be much of interest brewing. Summer could be a time in which the networks turned over a good parcel of their time to young singers, fledgling comics and low-budgeted, but imaginative drama in the propless style of say, CBS-TV’s “Camera Three.” But it won't happen. The networks, working under the assumption that the whole country is suntanning itself until 11 every evening, will fill home screens with second-hand goods and bargain basement fare. Their principal excuse is that viewing is down in the summer, but what programmers fail to take into consideration is that viewing is down mainly because quality is. CBS-TV’s “Playhouse 90” filmed offering Thursday night, "The Dungeon,” was a better-than-averagc chiller that lost some of its tenseness because of some improbable bunkum in its closing sequences. Dennis Weaver and Paul Douglas toiled in the cause. The Channel Swim: Polly Bergen would like to expand her talents into more dramatic roles. ABC-TV will fold its "Betty White Show’’ on April 30 and “Love That Jill” on April- 28. NBC-TV’s “Club Oasis" will go live through the summer. “Frankenstein” looks like a good bet for next sea-
