Study Challenge To Troop Use Powers Ike's Authority In Case Is Challenged ST LOUIS (UP) — A panel of three federal judges today considered a constitutional challenge of President Elsenhower’s power to use troops in enforcing racial integration at Little flock, Ark., Central High School. The challenge was contained in one of three cases brought before the U S. District Court of Appeals here. The judges heard oral arguments in all three cases Tuesday and took them under advisement. There was no indication when a ruling would be handed down. All of the suits appealed decisions by Federal Judge Ronald N. Davies which resulted in the integration of the Little Rock school last fall. In one case, Arkansas Gov. Orval E. Faubus appealed Davies’ ruling forbidding the governor from using National Guard troops to keep the Negro children from attending the high school. The other suits involved the President’s rights to send troops to enforce a Federal Court order Calling for integration, and an injunction by Davies preventing enforcement of an Arkansas state court ruling forbidding tionOn the troop issue, Little Rock attorney Kenneth Coffelt termed the sending of federal troops to Arkansas "a disgrace to civilized society." Coffelt appeared on behalf of Mrs Margaret Jackson, president of the segregationist League of Central High Mothers, who contended the constitutional rights of herself and her wo daughters were violated by the troops. Coffelt argued that Federal Court rulings are not laws which the President can execute under the terms of the Constitution. He said only Congress can make such ldws. Federal atorneys contended the term law in the Constitution is a general one which includes court decisions. In the Faubus suit, attorneys for the governor claimed federal courts lacked jurisdiction in questioning the discretion of a governor acting according to state law'.
