The ap- , proved appropriations are subject to the approval of the state tax ' board before they become effective. Laundry equipment, valued at $3,000, was approved by the board for use at the county home. A total of SB,OOO was approved for use by Lawrence Noll, superintendent of the highway department for the purchase of new equipment. Back pay in the sum of S4OO due to George Fosnaugh, superintendent of the county farm, was approved. Certificates of boiler inspection were filed at the meeting. The boilers of the county office were recently inspected’ and approved by the state inspectors.

Holds Extradition law Constitutional Indiana's Supreme Court Upholds Act INDIANAPOLIS (IP) — The Indiana Supreme Court, with Justice James A. Emmert dissenting, ruled Monday that the state’s 1935 extradition law is constitutional. The court ruled 4 to 1 against Edmond Johnson, who was ordered extradited from Vanderburgh County to Arizona nearly two years ago by then Gov. George Craig on a wife neglect charge. Vanderburgh Superior Court denied Johnson a writ of habeas corpus. He appealed on grounds he was not in Arizona at the time of the cremie and should have had a chance to prove it in the lower court. Johnson's attorneys contended the extradition law' violates both the state and U. S. constitutions. Emmert wrote a dissenting opinion which said the law is unconstitutional and that Johnson should have been permitted to offer proof he was not in Arizona at the time of the violation. . Enomert said the majority opinion could be interpreted to mean that Arizona could enact a law making it a crime for a son not to care for his father’s grave, and be extradited to face charges, although the son may not have been in Arizona at the time of his father’s death. 11 Convicts Break Ouf Os Dormitory Three Os Fugitives Recaptured Today FORT PILLOW, Tenn. (IP — Elev■en long-term prisoners over-power-ed a warden, broke from a lightly guarded prison camp dormitory! and scattered along the banks of4 the Mississippi River Monday night. Three of the fugitives were captured by early morning, including Jim R. Collins and William Cary. The convicts over-powered Deputy Night Warden Omar Teague, slashed one of his wrists and used his key to get out of the dormitory. Then they raced across the yard and vaulted a 10-foot fence to freedom. Warden Joe Barfield said a 50man posse caught Eugene Tucker, a life-termer, about a mile west of the prison. Tucker was quoted as saying the 11 had carefully ■planped the break, and had broken up into small groups after getting over the fence. Barfield said all 11 are longtermers with good behavior records which entitled them to be held in a minimum security’camp. But he said they were “not exactly on their honor ” Apparently there were no guns among the escapees, but prison authorities said it was believed all were armed with knives. New Effort To Raise Wreckage Os Train Engine Is Plunged Into Lake Michigan TWO RIVERS, Wis. (UP)—Railway officials today planned new efforts to raise the wreckage — and possibly the “ghost” engineer —of a switch engine which plunged into Lake Michigan. Tangled wreckage and murky water Monday prevented divers from affixing cables to the huge diesel buried under a boxcar which followed it on its eerie ride to the lake bottom. Divers also were unable -to clear up the mystery of whether an unknown person went to his death with the train. 1 The train made its wild run across five miles of switching tracks during the pre-dawn darkness last Friday. Starting at Manitowoc, it thundered into Two Rivers, knifed through the steel gates of a coal dock, jumped a bumper at the end of the line and ■hot across 60 feet of ground into the lake. Track has been laid to the water’s edge and workmen will use a rail crane in conjunction with a barge crane to lift the tangled mass of steel. Divers who made the plunge into 18 feet of water Monday were frustrated in i their initial efforts to attach cables to the engine when the remnants of a boxcar were found resting on it. , The FBI has been called in to help railway officials determine the cause of the mystery ride. Seeking To Escape From Murder Trial Second Legal Move Made By Attorneys SCOTTSBURG (IB—Victor Wayne Whitley. 26. a Texan accused of teaming up with a fellow desperado to kill two state policemen in a wild two-state crime spree last fall, lost a bid to escape trial on a murder charge Monday. But Whitley's attorneys promptly made a second legal move aimed at sparing the alleged slayer from trial on a charge of killing Indiana state trooper William R. Kellems on a Scottsburg street last Sept. 30. Floyd Circuit Judge Paul J. Tegart, sitting as special judge in Scott Circuit Court, overruled a defense plea in abatement which contended the grand jury improperly drew up an indictment charging Whitley with first-degree murder. Attorneys immediately filed a motion to quash the indictment. Tegart set oral arguments for March 19. — — Whitley already is under life sentence for kidnaping in the abduction of Jennings County Deputy Sheriff Clyde Perkins the same night Kellems was killed- He was sentenced in Jennings Circuit Court last winter. Whitley’s pal on a Michigan-In-diana crime spree, Ralph William Taylor, was slain by police bullets shortly after Kellems and a Michigan state police trooper were killed while trying to capture the two desperadoes. Pilot Walks Away From Crashed Jet WORTHINGTON (W — Lt. Delmar Fentress, a Terre Haute National Guard pilot, walked away from his damaged FB6 jet plane Monday after a crash landing on a farm near here. Officials believed Fentress was forced down during a weather flight by a defective electrical system. Jasonville Man Is Killed In Accident GOSPORT W — Harry Cowden. 46, Jasonville, was killed today when he lost control of his automobile on an ice-covered railroad overpass in Ind. 67. The car struck the side of th<+ bridge, plunged through a guard rail and fell 20 feet- Cowden was thrown out of the catapulting car and crushed beneath it. Frank Carlson (R-Kan.), said in a Senate speech that Congress should give “every consideration" to cutting taxes if necessary. He said Congress cut taxes during recessions in 1949 and 1954 and the result was an economic upturn. He said a tax cut in such cases provides "immediate relief.” Carlson said this recession seems to be following the 19491954 pattern. Mitchell confirmed what Vice President Richard M. Nixon had indicated Monday — that the administration prefers across - theboard tax cuts to "massive” federal spending on job-making public works. Nixon had advanced this as his own view Mitchell said in a speech at an AFL-CIO conference that the plan already is in the works. "It is ready for immediate use as an additional stimulus to the economy and it will be used if necessary,” Mitchell said. Unemployment Hits Peak The administration and Congress i also are planning expended public i works spending. The general tax | cut is still being held in reserve ,on an "if necessary” basis. In the same speech Mitchell reported that unemployment has hit a 16-year peak. He rounded it off at 5,200,000, an increase of 700,000 from mid-January to mid-Februs ary and two million higher than a year ago. After citing steps the administration already is taking to fight the recession, Mitchell said details are being worked out for a big tax cut in event the slump "proves more stubborn than is anticipated, or Congress fails to act** swiftly. "Certainly,” Mitchell said, “this is the next big step and is far preferable to massive new public works spending because it puts money in the haiids of consumers and investors.” President Eisenhower discussed the possibility of cutting taxes with Republican legislative leaders at the White House while Mitchell was addressing the labor conference. Some Prefer Public Works Some--Republican .Senators said they preferred public works to tax cuts. One of them. Sen. Edward Martin (R-Pa.l, told White House reporters he is "not for a tax cut at all ” He said more jobs would be created by investment in public works. If there is a tax cut, however, “I would favor one clear across the boards." Sen. Francis Case (R-S.D.) also, said the nation can get “more jobs from public works” than from cutting taxes. But Mitchell warned against broad spending programs which would not provide jobs immediately. He said a program which would go into high gear in 1959 might do more harm than good because it may compete for workers needed elsewhere.
