When you're young this is football weather, but as you get older, they're great days to sit around the fire and think back ——o o— _ Last call for winterising your automobile and also your home. Make sure those cracks under doors and in windows are covered. Winter will be here any day now. —-a—- o—— Colder weather is forecast foe this week-end and a few of the weather guessers believe we might have some snow. It's getting near that time of year when we can expect about anything and everything, weatherwise. ——o o—— Congratulations to Harry Schwartz, Decatur Ford dealer who this week opened his brand MOW, completely modern sales agency and garage on U.S. highway 224. at the west edge of Decatur. Mr. Schwarts has been conducting poen house at his new establishment and interest has been equally divided between his Ford cars and his hew Ford building. The President was not too pessimistic about the jump Russia has on the satellite business and everyone should like the reference in his speech that this nation was approaching its scientific study with a view to peacetime uses of inventions and not war. It was not a dangerous speech at all and at times Mr. Eisenhower waved the American Flag. Now he has the tough job of delivering. It’s a hard job in this nation to do what your conscience says is right in contrast to what your political friends say is right. Mr, Eisenhower is our President and as. long as be is, we must have faith in him. o o The police force has done a good job this week of patrolling the meters. Let’s all hope that the splurge is not temporary. There are still a few brazen truck drivers, mostly from out of town, who feel that the laws are not for them. They continue to park free, while making deliveries or drinking coffee. There should be no preferences shown and the same red tickets should be given all violators. These truck-men are well paid and when they park illegally they should.get a red ticket, the same as you and me. Any way it’s been almost as the ordinance meant for it to be this week. .

Articles Inform Public Os Services Os Lawyer
LEGALLY SPEAKING (This article is one in a series of 30 by the Adams county bar association presented as a public service by the Decatur Daily Democrat to inform the public of the point out various problems services of the lawyer and to which might arise when competent legal advice is not obtained. These articles are not intended to answer individual problems .which require specific advice.) ' .; THIS COULD HAPPEN TO YOU The bar associations have found generally that frequently some person, not a practicing lawyer, often undertakes to draft some legal document or offer some legal advice. The Indiana law provides that it shall be unlawful for any person not admitted to the bar of this state to solicit or procure a retainer or perform or render any services as an attorney by solicitation and the unauthorized practice of the law is a violation of the criminal” statutes of the state of Indiana. Experience has shown that persons not admitted to the practice of the law who attempt to give legal advice can create difficult problems which require many times the effort and expense to straighten out than would have been incurred, had the work been originally -done by a competent attorney. The following little story is one which actually happened, it could happen to you. John Quincy Blackacre was the owner of a nice parcel of real estate that he and his wife thought they had better sell since they were buying a more valuable tract of land. They contacted a local real estate agent to see about listing their ground for sale. Before long, the real estate agent called John and advised him that they* had found a good buyer who was willing to pay the full price they were asking and it would be necnessary to sign up a contract with the new buyers to complete the sale. Mr. and Mrs. Blackacre went to the real estate office, met Mr. and Mrs. George Whitacre, the buyers, and signed up the agreement. The agreement was a standard printed form commonly used by real estate agents to “bind” the transaction until the necessary legal documents including the abstract and the deed could be put in order. The contract, however, contained a clause that the seller should provide a marketable abstract of title brought down to the date of sale, and the buyers would have the privilege of having their attorney examine the abstract. When John bought the place he neglected to have the abstract examined because the real estate man he purchased through assured him verbally that the examination would not be necessary because there had just been an administration in the probate court where the court ordered the real estate sold and he court. Relying on this, John simpwould get a deed approved by the l.v recorded his deed without getting any title opinion from a lawyer. Now Whitacre took the abstract to his lawyer’s office for an examination of the title and here’s what happened. The lawyer found that five heirs owned the real estate a few years back and they all deeded the real estate to the wife of the real estate agent who was handling the transaction at that time. The wife acknowledged the deed as notary public 'which made the deed invalid for the purpose of recording it at the county recorder’s office. The lawyer examining the abstract of Blackacrq objected and required that these heirs sign a new deed. It so happened that one of the heirs had died and left minor children. Another heir was in serv-

ice in a foreign land. The upshot of the whole thing required that a “quiet title suit” had to be filed by Blackacre in order for him to give Whitacres a clear title, Blackacae found.this to be very expensive and he had to wait several months before he made settlement with his buyer. Cooperation of seal estate agents, accountants, insurance agents and persons dealing with the property of people in this community are careful to avoid indulging in the practice of law, however, occassionally you might find a person giving you legal advice or expressing an opinion concerning your legal matters. Consultation with your attorney concerning these matters is as important to you legally as consultation with your physician or minister in matters relative to their field. Often misinformation is given as to the costs of an attorney's services. When consulting with your attorney feel free to ask in advance the matter of fees which you might encounter. You will find he will be pleased to discuss the matter the same and as frankly as anyone else in the business world. Water Closets and Faucets Water closets and faucets should be examined frequently in order to keep the consumption of water on a normal basis. After a closet has been flushed and the tank is filled, there should be no movement of the water in the bowl; if there is, water is wasting into the sewer. By holding a piece of paper or cardboard against the rear portion of the bowl, a flow may be detected which an ordinary examinatlUa, would not disclose. STOP ALL LEAKS PROMPTLY as “a waste of water is a waste of money.” How to Shut Off Water A. The *‘shut off” valve known as the stop and waste, where the pipes enter the basement or building is your immediate protection in the event of a burst pipe or meter and also for the purpose of shutting off and draining the house pipes where and when there is danger of freezing; it should be easy of access and in good condition. In some basements it.is covered with coal or it is in such bad condition that it eannot be turned. The man of the house should see that the atop and waste is in good order and that the folks at home know how to operate it. To shut off turn handle so that it is at right angle with the pipe, one-quarter turn or if a wheel valve turn to right until completely closed. ALL SERVICE MUST HAVE A PRIVATE SHUT OFF INSTALLED AND IN WORKING ORDER!
