Silver Lake, was killed Monday evening when a car in which she was riding was rammed by another vehicle at the intersection of Ind. 14 and a Kosciusko County road west of Silver Lake. Injured in the collision were her son John H., 17, driver of the car, her daughter, Imogene, 20, both of Silver Lake, and Donald L. Keppel, 17, Wabash, driver of the second vehicle, and his brother, Charles G. Keppel. 16, also of Wabash. The injured were taken to Murphy Medical Center here for treatment of minor injuries. He ordered a “last meal” of sirloin steak and then asked for “six good cigars” to while away the anxious hours in his cell, located only 18 feet from the execution chamber. Warden Alfred Dowd said ‘lrvin was “extremely relieved at the news” when he informed him of the postponement. “It certainly was something to go through and I’m very happy,” tiie prisoner told the warden. Irvin’s attorneys, James D. Nafe and Theodore Lockyear,- pleaded tor one and one-half hours before Lindley on the front porch of the judge’s home. Deputy Attorney General Robert O’Mahoney of Indiana argued there should be no further delay. The defense attorneys contended the trial court erred when it seated eight jujors who testified tiiey already had formed an opinion on Irvin’s guilt. The attorneys charged the trial court also erred in admitting Irvin's confession as evidence ' Thej’ said the confession was obtained through coercion. Parkinson Denies Stay Dowd said the soft-spoken Irvin “exuded confidence” as time for his execution neared. He made no requests for last-hour visitors. About a dozen persons had been scheduled to witness the electrocution, including dowd, two priests, two physicians, and several guards and electricians. In a morning hearing at South Bend, Federal Judge W. Lynn Parkinson rejected a petition tor a stay of execution and then turned down an appeal motion on grounds it was “wholely without merit, frivolous and for deJay and not taken in good faith.” Irvin's attorneys then went to Chicago in the hopes of winning a stay from the appeals court, only to find the court was not in session and the seven judges were scattered.
