Defendants Substituted In the complaint Mr injunction and damages by Alvy Buffenbarger against the city of Decatur, the defendants’ motion to dismiss has been submitted. The court has ruled that the complaint be dismissed against the members of the former city administration and that the members of the present administration be made party defendants. The plaintiff has been ordered to amend his complaint within IS days. Motion Over Ruled In the complaint for damages by Embrey Tomato company against Otho Lobenstein, the defendant’s motion to make more specific has been overruled by the court. Rules for Plaintiff The complaint on promissory note by Schwartz Ford company against Hubert and Margaret Wolfe has been submitted and the court has ruled for the plaintiff. The defendants have been ordered to pay the sum of $76.70 for balance due and fees and costs of the action have also been assessed against the defendants. Complaint Filed A complaint to foreclose chattel mortgage has been filed by the Adams county Farm Bureau Co-op credit union against Dallas Dale and Vivian Ruth Brown. A summons has been ordered returnable May 17. The plaintiff alleges that the defendants owe $949.42 on a note and that they should also pay attorney fees. Estate Cases The supplemental report of distribution of the Louise Buuck estate has been submitted and approved. The administrator has been discharged and the estate is closed. The last will and testament of Grace M. Htmsicker has been offered and accepted for probate. A bond in the sum of $90,000 has been submitted and letters have been ordered issued to Forrest McWhirter, a nephew who has also been named one of the heirs. Decatur’s own reserve unit, a homeless waif since it was organized in December, 1955, has finally, found a home. Captain WiUiaif F. Gernand, battery commander of Service battery, 424th Field Artillery Battalion, said tolay, Headquarters for the active reserve unit is now established in the old Moses dairy building just north of Decatur on the Monmouth road. Service battery is charged with supplying ammunition for the three artillery batteries in the battalion, and also keeping battalion trucks maintained. Ammunition specialists, truck drivers, mechanics, and clerical help make up the main part of the local unit. The group got its start two years ago when several members oi headquarters battery, who lived in or near Decatur, decided that a unit was needed here. They had been driving weekly to Fort Wayne. The group received special permission for separate drills here. Still active in the group from the original members are M/Sgt. Robert Ray, Sfc. Norbert Bleeke, Sfc. Jack Weldy, Cpl- Luther Beitler, Sgt. Carl Lengerich, Sfc. Bruce Schnepp, and Pte. Robert Butler. Met Everywhere , At first the outfit met in the city council room, but that room provided inadequate, so it moved to the Community center. However, under the split-meeting arrangements with headquarters battery, no funds were available to pay rent. Usually only the kitchen was available for meetings there. The group next moved, to a va? cant novelty shop at Hammond’s market. From there they moved to Phil Sauer’s storage shed, but when that was rented, they moved to the second floor of the Redmen’s hall. Unexpected Cool Wave Hits State Force Revisions Os Earlier Forecasts By UNITED PRESS An unexpected pool wave slipped into Indiana today and forced revisions of earlier forecasts for abnormally warm weather the rest of this week. » Temperatures dipped as low as 44—at Fort Wayne—and 45—at South Bend—early this morning and were due to fall within a few degrees qt-fceezing in the eadssme north portion tonight. Weathermen previously had indicated daytime temperatures would range, into the 70s and possibly 80s the rest of this week. However, revised forecasts called for tops today ranging from 60 to 68 ip the north to 68 to 75 in the south, lows tonight ranging from 38 to 54, and highs Friday ranging from 60 to 70. Precipitation was conspicuous by its absence again, although there was a chance of showers in the extreme southwest portion today. The outlook for Friday and Saturday was dry and. continued rather cool. —— Temperatures hit the 80s throughout the state Wednesday, including 81 at South Bend, 82 at Indianapolis and 85 at Fort Wayne and Evansville. H the VFW home, which was occupied until March 1 of this year. During this time the group was trying for official recognition, and finally received permission to organize as service company of the battalion. Veteran Outfit Capt. Gerhand, a World War II veteran, had been out of the reserves for about five years, but he unofficially headed up the group until his commission was restored. He is now assisted by Ist Lt. Marvin W. Stucky, and Ist Lt. Henry S. Commager, who also is organizing a fire direction center on Thursday evenings in Fort Wayne. The local group meets once a week at their new headquarters, on Tuesday nights, for two hours. Actually, many men arrive early and leave late, dedicated to the small organization which they have established here. The unit is only authorized at below-strength roster of 57 men and three officers. Presently, 28 men and three officers make up the entire compliment. Local Man Arrested On Bluffton Charge Fred Engle, of 219 Rugg street, was arrested yesterday in Bluffton by the sheriffs department there. He is to be arraigned today in Wells county circuit court, and charged with driving while under the influence of alcohol. Engle has two previous convictions for the same offense. Make Safety Checks Here Os Automobiles The Decatur city police and state police are cooperating in making Cotnrtegy safety checks of automobiles. The police officers are checking-moving vehicles on various streets, and checking lights, turn signals, brakes, and drivers licenses. The checks, which started on Monroe street yesterday will continue throughout the month. Safety check stickers are given to cars which have been checked.
