Israel Refusal Is Rejected By U.N. Secretary Rejects Refusal By Israel For Return Os Disputed Strips UNITED NATIONS, N.Y. (UP*— Secretary>-General Dag skjold today rejected Israel's refusal to return the disputed Gaza and Aqaba strips to Egypt He recommended that troops of the United Nations Emergency Force be sent iMo the Gulf of Aqaba area and that Israel, which has insisted on prior guarantees against Egyptian military active ties there, withdraw its troops immediately without conditions. He also rejected Israel’s plan to maintain civil- administration in the Gaza strip, which juts 26 miles north of the general armistice line of 1948. Israel had suggested that Gaza might be taken over by an international regime with Israeli maintenance of civil services. In a written report to the General .Assembly’.- Hammarskjold stood firm on the U.N.’s demand forfwithdrawal of Israel’s forces from both areas. , But he catted for measures to present a return to conditions which led to Israel’s attack on; Egypt last October and to make * the 1949 Palestine armistice agi»o- - in effect ah Operating ndffaggression pact. Hammarskjold based his conclusions largely on the 1949 armistice agreements and decisions of the US. Security Council. These, he said, gave no Country a claim to belligerents’ rights, and therefore ruled out an< justification for Egypt’s blockade at Ute Suez Cafial or the strategic Gulf of Aqaba against Israeli shipping. His carefully worded, 2,500-word report made these chief points: 1. The UN. cannot accept Israel's claim to the Gaza area, in which Premier David Ben Gurion has proposed Israeli maintenance of civil services and administra-. tion while perhaps turning the area over to an international regime. ■ ; 2. Israel is required to withdraw its forces from the Sharm-Al-Shaikh area which dominates the Gulf of Aqaba but UNEF forces would follow “in the same,way.as in other parts at the Sinai peninsqU- to act as a buffer between -opiAsing forces and “secure and maintain'’ the cease-fire.’ " “ 3. UNEF forces should be sent into the Gaza Strip and into Israeli territory opposite the disputed El Auja area south of it, established as a demilitarized zone under the agreement. Israel’s refusal to evacuate El Auja has brought. Egyptian contention that this made the armistice agreement inoperative. 4A Possibility for peace in Pales-tine-depends upon full implementation' of the armistice agreement, including its provisions on Gaza, El Auja and Egyptian-held El Arish. ■ 5. There are no Egyptian military positions in the Gaza-El Auja area affected by the present situation. To fulfill the armistice agreement’s stipulation of “reciprocity” in withdrawal from the demarcation lines. there should be Egyptian assurance that Egypt’s forces will not occupy the controversial areas.
