Indiana Toll Road Commission Sued Chicago Firm Sues State Commission INDIANAPOLIS (INS) — The way of a toll road is paved with I law suits —and the Indiana toll road commission had another one J on its hands today. The commission is defendant in a suit filed by Kornacker and Associates. of Chicago, for $980,694 in Marion county circuit court. . The suit claims that the money is due in unpaid fees ahd damages caused when the firm was asked to quit a: engineering and construction supervisors for a section of the east-west toll road across ■ northern Indiana. The section between Elkhart and South Bend now is under the supervision of the Tecon Engineers. Frankfort, Ky Executive secretary Albert J. Wedeking of the Indiana toll road commission, claimed that the Kornacker firm asked to w-ithdraw-
; from its contract when it learned that its six and one-fourth percent fee would be on a total construction cost of $9,460,000 rather than the estimated $14,529,424 cost. The suit, filed Tuesday, claimed the Chicago company agreed tb accept $908,089 as fees for supervising construction and engineering of the toll road section. It asked $430,919 unpaid of this sum. plus $149,775 for extra expenses due to changes in plans and $400,000 for damages suffered by contract termination. Roman Rooster A Costly Bird MANCHESTER, Eng. One witness claimed that the bird’s crowing sounded like “the wailing of a banshee in great dis- . tress.” Others told the court that the rooster started crowing around five o'clock every morning. Ohio Turnpike To Be Opened Friday Preview Is Given To Newsmen Tuesday CLEVELAND (INS) —Ohio’s 241 mile ribbon of concrete stretching from Pennsylvania to Indiana is ready, willing and able to handle the steady stream of traffic which will begin flowing at midnight Friday. Newsmen from every section of the state were given a preview of the $326 million "bhby” Tuesday in two segments. One tour left from Toledo | and proceeded to a point east of Fremont and the other departed from the Strongsville interchange near Cleveland and headed to the Pennsylvania state line where the turnpike joins the Keyston State "pike.” Eventually, when the Indiana turnpike and a bridge across the
