Sheppard Case Jury Reduced Today Te 10 Sudden illness Os Juror Threatening To Stall Selection CLEVELAND (INS) —The jury in the murder case of Dr. Sain Sheppard was reduced to ten today when a panelist was excused for illness and another was challenged by the defense. The sudden illness of juror number four, Thomas J. Solli, threatened to again stall the jury selection which had appeared to be nearing an end when the state announced it was “satisfied" with thpte seated. The departure of Solli, father of three children, left the panel with six women and four men and the defense with only two more peremptory challenges. The “pool” of 75 Veniremen was down to 11 and it appeared a new group might have to b summoned before 12 jurors are finally seated, together with an alternate. The defense used the fourth of its six challenges to oust Negro elevator operator ‘Dorothy bee, who was seated Tuesday night. The action came as the family of the accused brain surgeon was barred from talking to him in the courtroom. With the departure of the petite Negro, the jury held six women and five men. During a recess, the defendant's attorneys and the prosecutor “met in the judge's chamber tb discuss a motion to permit the osteopath to attend the funeral of his wife’s grandfather, H. P. Blake, Wednesday. The judge took the motion under advisement. Juror number four, Thomas J. Solli. announced that he was IJI shortly before the court recessed. The court ordered both side's to come to his chamber with the juror, who has been giving indications he was not feeling well the last two days. Stephen Sheppard, ahgrily described the ruling by sheriff Joseph Sweeney as “asinine.” Sheriff Sweeney said he ordered the family to keep behind the railing separating the visitors from the eoutt floor because “that's the rule around here.” Before the sheriff acted today, the family of the defendant had congregated around him during re-1 ce»-es and held conversations with | him.
