Find Discrepancy In One Zone Area Two Lots Omitted In Residence Zone John A. Dierkes, of 1321 Nuttman Avenue, appeared before the city, council lash night to find out why two lots on Nuttman west of 13th street have been zoned light commercial when there are already houses on them. Two years ago Dierkes and his neighbors had asked that the area west of 13th street on Nuttman, which included homes, be zoned residential. At that time an abstract was prepared, the residents of the area signbd a petition, the city zoning commission approved it, and the council amended the original zoning law to include the changes asked by the petition. All members of the council, the mayor, city attorney, and city engineer were of the opinion that the request of the residents had been complied with. However; the owner of the two corner lots, Herman Dierkes, hired an attorney to prepare an abstract of the lot so that he could sell it. The attorney discovered that the two corner lots had been omitted from the description of the area to be changed to residential, so that they remained light commercial.. This omission was in the original petition, approved by the zoning commission and city council. Herman Dierkes had previously thought the lot was zoned residential, and had even obtained a petition asking for it to be changed from residential to light com-mercial,-so that the lot could be sold to an oil company for the building of a service station. John Dierkes* attorney, David A. Macklin, asked that the city council rectify the original mistake, and change the two corner lots to residential. Macklin was asked by the council to get the original petition from the city safe, and bring his suggestion before the zoning commission.
