Niblack. Nibiack's ruling last summer on a civil suit filed by the Gary school city wa* upheld by the Indiana' appellate court, but »tgte school Supt. Wilbur Young re quested; a transfer to the eupreme court tor a fiual ruling. Thus, the supreme court holds the key tQ whether the Feb. I distribution is made on that date and must rule within the next tew days to avoid a delay In handing opt payments of around 330.600,b&0. state auditor Frank Millis, who sends out the check*, said it there is a delay most schools either will have to dip into their working balances or borrow money to pay teachers until the dispute is settled and the funds released.
