Driver Fined For Overloaded Truck Local Man Fined In Logansport Court Logansport, Ind., Sept. 7—(UP) -Indiana's t»4» truck weight law held Cast today despite the efforts of two truckdrivers to find a loophole In It. Itayuiond Shoaf. Decatur, and itussell Durnau, Mafkle, both arrested July 1? for overloading trucks, lost in Logansport city court yesterday when they said the law was unconstitutional. The men said weighing trucks by state police was an unreasonable search unless an affidavit authorising the weighing was Issued. But judge Harry V. Tutewiler overruled their claims and upheld the law. "It seems that under the statute, the legislature has seen tit to condition the use of highways by trucks in that they have limited poundage as to gross load and axle load,” he said “This action by the legislature no doubt was taken to protect highways from abuse by truck operators." Shoaf was fined WO for an overload of 1.000 pounds ‘and Barnau WOO for 6.C00 pounds. Both were arrested by state police at permanent weighing scales on U. 8. 34 west of Logansport.
